Isn't 1st degree the norm when it's pre-meditated / pre-planned with 2nd degree more the "crime of passion" kind of situation?

If the reports are correct with respect to the guy just going there to confront the doctor and then shit escalated to the stabbing, wouldn't that be 2nd degree?

I could be way off base on the criteria for 1st vs. 2nd too.

If he brought the knife in himself, I'm sure that's pretty much 1st degree.

First degree murder in Canada is classified here:

    http://laws-lois.justice.gc.ca/eng/a...ction-231.html

I'd say bringing a knife qualifies as planned and deliberate. I'm going to guess it probably passes the criminal harassment test as well, unless this is the first time confronting the doctor.

Assuming he brought the knife there, it's possible he grabbed it from next door after initial encounter.

But he still had the time and mental capacity to deliberately go grab the knife with the sole intent of hurting him.

Could the argument be made that the knife was purely for intimidation purposes and he had no intent on killing until the taunting escalated things (assuming that's actually what happened)?

^ yes, but as rage2 mentioned that would fall under criminal harrassment and it would mean the murder was 1st degree.

I think for a fairly simple explanation, that's a pretty good way to look at it.

I think there is a lot of evidence that we aren't privy to that led to a first degree murder charge, which can't be laid without consent of the Crown after review of the evidence.

Obviously there are people with far more knowledge and ability who make those calls, but I'm not one of them and can't offer much insight about that stuff!

Says here that the accused man's wife was at the clinic when the incident happened. Perhaps he caught them in the act?

    http://calgaryherald.com/news/crime/...fatal-stabbing

Coleman said the accused man’s wife – described as a regular of the clinic who had been seeking treatment from Tiejun Huang for “a substantial period of time” – was at the clinic at the time for an appointment. Her husband arrived a short time later.

“I believe he was quite agitated, attended the clinic, searched out the doctor and engaged in a verbal altercation, which ultimately led to a physical confrontation and the stabbing of the victim,” Coleman said.

Well defense is not doing their job if they don't at least try.

I was about to post that article too... specifically for this part:
Both lawyers asked that their submissions in the sentencing hearing be delayed so they can further investigate mental-health issues raised in psychological reports done on their clients.

Stephensen noted his client was diagnosed with schizophrenia and wants to determine if he was on his prescribed medications at the time and, if not, what effect that would have on his level of culpability.

Hepner, meanwhile, noted it was suggested his client may have fetal alcohol syndrome and needs to explore the effect that would have on sentencing.
