Long story short, I live with my wife who owned before we started dating. I was always under the assumption I could use the first time home buyer credit when we bought a detached house after we got married. Turns out I can't use it now based on what our broker told us.

Any ideas if there are legal ways for me to still use it?

I dont have an answer but saw this on the CRA site:

You are considered a first-time home buyer if, in the four year period, you did not occupy a home that you or your current spouse or common-law partner owned.

Notes
Even if you or your spouse or common-law partner has previously owned a home, you may still be considered a first-time home buyer.

If you have a spouse or common-law partner, it is possible that only one of you is a first-time home buyer


so yeah, it can get confusing I think. I would just call CRA.

Well we definitely did not live together 4 years ago. Probably 3 years though.

The wording on CRA's website is a little different then 4 year period:

"you did not live in another home owned by you or your spouse or common-law partner in the year of acquisition or in any of the four preceding years (first-time home buyer)."

Given that you said you lived with her for 3 years and she owned the property, chances are you wouldn't be able to qualify for the credit.
