    Default Is My Condo Board Allowed To Just Install Speed Bumps?

    When I was shopping around for a condo in 2009, one of the largest factors in choosing one was picking one without speed bumps. My car is about 4 inches off the ground so I can't really get in nor out of any place with speed bumps. There are certain gas stations and grocery stores I simply can't go to.

    A couple of days ago my condo board got a paving company in to replace most of the damaged pavement near the entrance to our complex and today, right at the end of their paving line, I notice a speed bump the entire width of the entrance with a space in the middle for motorcycles. I barely made it over the bump, I can't be doing this multiple times a day, I'll be out there forever trying to get in and out. I'm the only lowered vehicle in the complex so nobody else is going to care but this is a huge problem for me.

    Are they required by any bylaws to contact / ask the unit owners prior to installing something like this? Are there any other bylaws referencing this? I found the Alberta Condominium Property Act here: http://www.qp.alberta.ca/documents/Acts/c22.pdf but it's a lot of pages to look through. I did some quick searches and didn't find anything relevant.

    I should note that I go to all the board meetings and there hasn't been one since last year.

    meh, you get used to it. 4" is a ton of clearance

    If you take anything I have to say seriously, you're gunna have a bad time.

    As long as the board makes decisions in good faith, it is their power to do so.

    This is why I was on the board of every condo I ever owned.

    There was no notice or anything? I suppose its there now, not much to be done about it. Had they sent a notice I guess you could have raised a concern.

    I don't think there is much you can do here, as sucky as that is. Even if you had some legal leverage I imagine a court would find it unreasonable to have the bump removed using the condo purse just because your car is slammed.

    As an owner you are not invited to board meetings. Just the annual general meeting.

    Yes it is well within their rights to install speed pumps.

    You do not go to the board meetings unless you are on the board, you probably go to the AGM (once a year.)

    And yes, they can and did install speed bumps. Enough if not all of the board members agreed on the decision.

    Have you ever seen a condo board? usually the elderly/infirmed/fat unemployed guys with nothing else to do other then get wound up over something. Ofcourse they're gonna vote to put in a speed bump.

    4" of ground clearance in Calgary?? Youre just asking for a manhold cover (or the like) to rip out your oil pan. I used to own a vehicle that had 5" inches (previous owner) and that was just plain stupid. This isnt California.

    Someone had something happen to them by a condo board at one point lmao

    Lots of factory rides have ground clearances that are quite low - Chev Sonic off of the showroom floor sits at 4.9 inches.

    Board meetings are for board members. You can ask for the minutes to see who was in attendance and if there was a motion called and if it passed with a majority…

    Board members are elected during AGMs, any owner can be a board member if you can garner the votes in the AGM. Unfortunately, if you don't go to AGM's or choose not to be a board member or vote you lose your vote.

    Board members have the right to make motions and vote on motions… sounds like you could have a chat with a board member to bring it up in next meeting to have it removed or get yourself on the board so you can bring the motion up yourself.

    x2, the board has the right to make decisions relating to the property without directly consulting owners - that's why they're elected positions. I spent 7 years as VP of a condo board and it was an interesting experience.

    Correct, I go to the annual meetings, not the board meetings.

    I have 215/35/18 tires, I'm at Alberta Wheel Repair every couple of months. My wheels are all kinds of fucked up.

    Site Note: Alberta Wheel Repair is awesome to deal with for repairing wheels.

    So now I live in a place with speed bumps? This is just dandy. Maybe I can just drive around them on the grass.

    Hmm I'm running 35R20 rims, and I still haven't had to get them repair since I got them about 3 years ago, how are you driving?

    If they start creating drainage or snow removal issues (which I bet they will) then you might have some reasoning to force the condo board to remove them. There’s a reason where there aren’t speed bumps in private residential sites.
