View Full Version : Someone please clarify Alberta tint laws for me

Tried searching for this but couldn't really come up with anything too concrete. Got fined $57 for my having my side windows done (I don't have any rear sides, just one big piece of glass on each side with no division) a few weeks go. Now I don't think I'll be able to fight it cuz the court date is on day of work that I can't get out of and it's not that big a fine really, so whatever, but I wanted to know if there was a way to fight this ticket?

I am aware that legally you're not supposed to have your driver's and passenger side windows tinted. But the grey area supposedly is that if it's light enough that you can still be seen through it (in case the cops want to look through it), then it should be ok. For this reason, that's why I was told I couldn't get any darker than 35% on my sides. Which was fine by me, so I had 35% done on both sides and my rear hatch window too. Now, correct me if I'm wrong, but dealerships will allow a similar 35% cap even on the front sides of a car if you have them put it on before you take possesion of the vechile, isn't that so?

So if I've got tint that's within factory spec, and the fact that I clearly made the effort not to go too dark, shouldn't this help me get out of the fine or at least have it reduced??

EDIT: Afterall, if it's illegal to have the front sides done, why are dealerships and tint places allowed to put them on?

If i remember correctly, any tint on any windows of a car is illegal unless it was put there by the factory.

Usually cops don't ticket you for this unless you are pissing them off and you are just looking for more tickets.

Law says NO tint on passenger/driver side windows above the shoulders. 30% is tint, No tint means nothing.

Yes dealerships have cars tinted from the factory, which would be my question if someone could find the rule book on it. But if its factory tinted windows, its normally smoked or tinted windows, not tinting film on the windows. Factory spec isn't that dark therefor I believe it isn't an issue because the cops can still see you.

You can't make a car equivilent to factory to staisfy the police, it has to come from the factory like that.

Bylaw is that there should be NO tint past the sholders of the driver... therefor no tint on the front windows. Dealerships will not tint the front windows for you unless they are tinted at the factory (tinted at factory = not film tinted).

tint places do it because its not illegal to put them on.. it's illegal to have them... plus most places let you know that it's illegal to put it on the front windows.

That's the thing though, I wasn't doing anything stupid in the first place when I got pulled over it. I hadn't even left the parking lot from work yet when I got this ticket. The cop was just passing by me in the parking lot as I was getting out of the lot to get onto the main road. :banghead: I was pulled over for the tint and only that. Just some stupid luck that I got spotted by someone anal, I guess. Should I bother fighting it or just pay the fine and carry on? I've had this tint on since end of July and this is the first time I got hassled for it.

man the ticket is $57 i spend more then that on porn in a week. You broke the law by having tint on your windows. Fess up and pay it.

also if you fight it they might tell you to strip the tint off your windows if you dont want to pay the ticket...and no1 wants to do that

In Alberta, you are allowed to add film tint to the windshield up to 15cm from the top. Reflective tint is not allowed. You are not allowed to add film tint to any windows beside the driver. So any windows on drivers door or passenger doors are prohibited from being tinted. For vehicles with a small triangle window ahead of the door windows, those can't be tinted either. There's no "above the shoulder" rule. You can NOT tint any part of the windows beside the driver.

The laws aren't there so cops can see you. It's there so pedestrians can make eye contact with you when crossing the street so they know if you're looking at them and see them when they cross so they don't get nailed.

Tint laws also vary from province to province. In Manitoba and Quebec, you're allowed to have tint on the front windows beside the driver. In Nova Scotia, no tint is allowed. In some provinces you're allowed front side window tint if you have a medical reason and a certificate from a doctor. In Alberta, even if you have a medical condition and a doctor's note, you are not allowed to have tint up front beside the driver. (I know someone who tried this and failed).

Above shoulders i ment infront, not above. Bad choice of words. So B pillar forward no go for tinting.

When I talked to the cop about the tinting he didn't mention the pedestrian thing although sounds very realisitic. He mentioned they put it in place so when walking up beside the car they jus tpulled over or are checking out, they can see in and make sure it is safe for them to carry though. If they can't see in and all of the sudden a bullett goes through the window and hits them, that wouldn't be too hott.

At night in a dark area, even with no window tint, a cop can barely see inside a car anyways. That's why cops have flashlights.

A nice trick to get out of tickets.... When you get pulled over, shut off your car, roll down your windows, put your hand on the top of the steering wheel. Cops feel much more comfortable approaching a vehicle when they can clearly see inside a car and clearly see your hands. Be nice to them, and there's a high chance that they'll let you off with a warning. I've gotten out of over 50% of tickets I deserved by doing this when I get pulled over. I got pulled over with 2 chicks in my benz in the passenger seat (it's a 2-seater). Super polite to cop, I was designated driver, no ticket, and he even escorted us home because it was impossible to throw on seat belts.

Yes I would agree with rage 100% there. Automatic windows help, just hit the button while your pulling over and save yourself ALOT of greif(sp), hands on steering wheel, be nice.

rage, not on the tinting topic but to do with the laws and such. Is there anything specific for DD's or anything being a DD we shoudl know/say to help us out if we do get pulled over? I always seem to end up being DD for most of my buds since I don't want to ruin my baby so I don't drink so I drive them all home, wouldn't mind knowing some things to help me get them all dropped off without alot of trouble. I know some dude down south said he was DD, was still breathlized, had one beer but was well under the limit and still got a ticket for something (forget what it was) aswell as his passengers got a ticket for DUI which doesn't make sense since they weren't driving.

I don't understand your question. If you're a DD, you're not doing anything wrong. So what's the problem?

I just use the DD line when I am the DD, and I do something stupid such as speed or drive too many ppl in a 2 seater heh.

Yah I understand that but someone in south calgary got stoped at the checkstops for it and ended up getting a ticket because the cop didn't believe him. I mean if the car is full fo drunk people and the driver is sober, its fairly self explainitory is it not? So why are some people possily still getting tickets because of it? Just lipping cops off or something?

I have no clue, I've never had ANY problems at checkstops. Well, except this one time I washed my car and went thru a check stop. I had my top down and my windows up and was enforcing my Window rule... no rolling down windows 6 hrs after a car wash cuz it makes it dirty! Anyways I said I dont want to roll down my window, he made me do a breathalizer test, I passed cuz I haven't had a sip of alcohol in like 5 years at the time and he let me go. And yes, my windows stayed up the WHOLE time haha.

You can't have anything translucent, transparent or opaque on any window beside or in front of the driver.

Go to your local library and all the HTA is there for you to read. Word for word.

Anything that you apply to your driver or passenger side windows can be taken as illegal. Same with anything on the front windshield.

To the letter of the law anything on those windows is illegal. No question about it.

The only thing that varies is if the police feel like enforcing it and issuing you at ticket.

Fawk i must be lucky, never been in shit for tint at all.. ive had one of my old supra's was limo all around, got pulled over for speeding , rolled down the window infront of the cop and when he walked away rolled it right back up, till he came back cuz it was rainin out.. my old 71 cutlass was limo all around also, yet again no probs... my old 3/4 ton gmc was 35% on the fronts and limo on the rear, cops would pull up next to me look over and never did shit all.. same thing even with my yukon now, fronts 35% for bout 10 months now been next to cops i dont know how many times almost 1 cop every night, on top of havin clear tail lights... yet again still havnt gotten in shit .. so i guess horse shoes up my ass...

Window glazing

69(1) A person shall not install, replace or cover the window glazing in a windshield or in a left or right side window of a motor vehicle that is beside or forward of the driver with a transparent, translucent or opaque material.

(2) A person shall not install, replace or cover the rear window glazing in a motor vehicle with a transparent, translucent or opaque material unless the motor vehicle has outside rear view mirrors on both the left and right that comply with section 72(2).

(3) A person shall not install, replace or cover the window glazing in a motor vehicle with a material that reflects the headlamps of approaching vehicles into the eyes of the driver of another vehicle.

(4) A person shall not install, replace or cover the window glazing in a motor vehicle with a material that reflects sunlight into the eyes of the driver of another vehicle.

(5) A person may replace the window glazing installed by the manufacturer of a motor vehicle with the same type of glazing.

(6) A person may apply clear untinted frost shields to a window of a motor vehicle only if they do not impair the view through the window by discolouring, scratching or damaging the glazing.

(7) A person may apply stickers to the window of a motor vehicle only if they do not limit the driver’s field of vision or otherwise impair the safe operation of the motor vehicle.

hmmm.. I was pulled over for tinted side windows AND tinted windshield. The cop reached in and peeled the tint off the top of my windshield.... now lets talk about JERKS lol. I would have taken and paid the ticket no problem.. But I wasnt given the option

Just so everyone knows-this happened to me tonight-they are handing out 57.00 tickets, plus 175.00 ticket for "failing to obey police officer to provide safe motor vechile activity" since I had a warning about my tint in past-fawkin bs
