I was just wondering if anyone knew anything about the apparent 50/50 fault rule when in a parking lot accident.

The other day some guy drove right into the side of my parked (and turned off) truck while he was turning into his parking stall.

Do you think (or know if) the 50/50 fault rule would still apply, given that he hit a stationary object? I could see if perhaps both vehicles were moving and collided, but it seems weird to me that it would still stand with my situation.

his 100% at fault. 50/50 is only when both cars are driving....

My buddy hit a parked car before and he was 100% at fault, no 50/50

50/50 in parking lots rarely apply. Even if you are driving. Some woman hit my rear bumper when I was driving in a parking lot and said 50/50. I called my insurance and they got her to pay the damages. It was 100% her fault.

Your case, you car was stopped. 100% her fault. Heck, if it were 50/50 I would go around in my friends 88 Hyndai and hit people for the hell of it since I wouldn't have to pay a cent.

Generally, it will be 50/50 if both parties are in their cars/ haveing their cars in motion. If one party wasnt in the car, then it will be 100% their fault :thumbsup:
