I was driving today in a residential icy road, it was my first accidend and i have no previous tickets/accidents or anything. So this kid 16 years old was driving his dads volvo SUV and it is a tight corner I am about to turn and he cuts the corner and is on my side of the road. I tried to stop but i ran into his drivers side door and damaged that and he managed to break my driver side headlight front bumper, hood and front driver side quarter panel. I know i hit him but he cut the corner who is at fault, I was also going below the limit and he was travelling faster than i was i am just not sure how much. Could any of you guys on the forum be able to tell me who is at fault and if there is anything i can do so i dont have to pay at all.

Thanks very Much,

Ryan

Well, did you call the police? They are usually the best to decide who is at fault since they dictate and upholds the rules of the road.

unfortunately no witnesses, and to make it worse by some strange twist of fate our parents our old friends, unknown to us at the time of the accident

Yea, his dad was their best man actually. Which kinda sucks cause if there is a large discrepancy and legal action insues it will just be bad.

That whole thing sounds messed up... Really depends where the point of impact was. Anyway, if you can prove that he moved OUT of his lane (by cutting the corner) with tracks or whatever, it is his fault. Only problem here is the onus of proof lies with you. The police will assess the situation accordingly. this is where the digital camera would have come in handy...

This is why you take pictures before you move the vehicles. If you had a picture of your car still on your side of the road, and his on your side of the road, there would be no argument.
Exactly why I'm getting a camera phone soon.

I don't know who'd be at fault but I do know that it would be worse for you to be paying higher insurance for a while than some friend of your parents not being friends anymore. If he is really at fault, then I'm sure it wouldn't ruin any relationship between your parents and their friends, it has nothing to do with their relationship.
