No satellite equipment on here allowed unless it's equipment from an authorized canadian satellite provider (Bell ExpressVu and Starchoice). This is not Memory Express. This is beyond.ca and we run by OUR rules. Canadian laws state that only equipment that's legal is equipment provided by licensed DTH providers. SC or BEV. That's it. Not happy with the laws? Go fucking change it.

Post this again, and you'll get banned.

Also, your post was excessively rude. I didn't know that calling the mods "overzealous" was such an insult to warrant the flame. I was trying to draw attention to the fact that this hardware is 100% legal to buy, sell, and use.

The point is - I'd like to sell this hardware on beyond. I'd like to ask you to allow me to do so and honestly consider my points above about the legality of it, or to clarify the marketplace rules. As of now, I see no rule implemented that forbids me from selling this.

If you want to talk legalities of Satellite with me, I know WTF I'm talking about. It helps that this was explained to me by both RCMP and FBI agents that I've worked with.

Let's start with the Radiocommunication Act of Canada.

Section 9.1.c states:

No person shall decode an encrypted subscription programming signal or encrypted network feed otherwise than under and in accordance with an authorization from the lawful distributor of the signal or feed;

This closes the door on illegal decryption as well as grey market (Dish Network) decryption. Dish Network is NOT a lawful distributor in Canada, thus you will never get authorization. Besides, most of Dish Network's channels have rights owned by ExpressVu, Starchoice, Shaw, etc. so you need their authorization. It's been fought many a times in the courts, and the courts have ruled that section 9.1.c also covers Dish Network and DirecTV signals.

Next, section 10.1.b states:

Every person who without lawful excuse, manufactures, imports, distributes, leases, offers for sale, sells, installs, modifies, operates or possesses any equipment or device, or any component thereof, under circumstances that give rise to a reasonable inference that the equipment, device or component has been used, or is or was intended to be used, for the purpose of contravening section 9,

Bam. Because you're posting on beyond.ca, beyond.ca is now offering such an item for sale.

But wait, it could be used for FTA too right? True, but the primary purpose is NOT FTA. Find 100 FTA cards/boxes, 98 of them will be used for piracy. anyway, jackboot, while they can technically be sold legally, things kind of go out the window when you imply what you did. if you got taken to court and had a decent lawyer and enough cash, and sold a clean FTA (and didnt tell people about piracy or imply it at all), youd probably come out fine.

the thing is, no one here wants to have to deal with that or take on any risk whatsoever for other peoples sales. no one is going to start asking questions if people sell radar detectors, but they will if there are any signs that its serving as a distribution point for piracy. forums are actually targeted pretty regularly by satellite companies. theyve got millions on the line and they have the budget to choke whoever they can find. kinda of like the RIAA lawsuits.

so, its just easier for everyone if the marketplace steers clear of that. its not that the admins give a shit if you break the law, they just dont want to have their name near it or have to answer any questions ;)
