View Full Version : Tow Truck Dropped My Car!! Need Advice!!

Ok so here is the story... I was cruising down calgary trail two days ago when all of a sudden I lost all boost and started to blow black smoke out the exhaust... I couldn't find the problem at the moment as it was 2 am and dark where I was... I now find out the boost lines coming off the bov was the problem but anyways...

I called a tow truck to get my car to my house... I called Kingsway towing... They said it would be 3 to 4 hours before they even made it to my car and that if i left the key under the floor mat the car would be at my house after that...

THIS IS MY FIRST MISTAKE!! NEVER LEAVE YOUR CAR WHEN ITS BEING TOWED!!! but i was working the next morning at 9 am...

Anyways at about 6 in the morning I get a call from the towing company and it went a little like this...

"Hi, this is kingsway towing and we have some news about your car..."

At this point I figured the car was to low for them to tow and now I will need a flat bed and it will take longer...

So I ask... "What's that?"

They reply with... "We dropped your car off our tow truck..."

Now at this point i'm not sure if i'm stunned or pissed, probably both... I then ask for the how, and this is what was said...

"Well the driver didn't feel that where the car was parked it was safe for him to get it on his truck... (Where the car was i was visable for more than a km each way, but anywho...) So he lifted the car by the front end just to move it... He figured that it would be safe to get the car all the way to my house... (Which by the way is by WEM)

Boy was he wrong...

Apparently what happened was while driving threw a residential he hit a bump and allegedly the parts that hold the wheels to the truck flew off and well so did the car... Car dropped an estimated 3 1/2 feet, hopped up a curb, and flew into a big mail box that was bolted to the ground...

He broke my HKS FMIC, rad support is pushed in, hood, fenders, window washer fluid bottle :p, dent in the frame rail, and the wheels look like this / \ so i'm pretty sure the coils is done and some other suspension parts, also the possibility of the frame being warped...

I went to talk to the owner of the company today he starts telling me it wasn't the drivers fault and that it was because of my exhaust... and his solution was that he gives the car to his so called "specialist" who didn't even know what a FMIC was... and he CUT the fmic's bottom 3 rows which are crushed and weld in a piece of aluminum... and for the rest i dont even want to get into it...

At this point I just left...

Now my question is what would you guys do in this situation if you were in my shoe's? I think it's pretty awesome how much they don't care sometimes...

Also they didn't report this to the police which is illegal I do believe since there is a lot more than $1000 worth of damage plus the damage to the mail box my car did to it... Are you not supposed to report any accidents that damage government property?

yes any damages over $1000 have to be reported and any property damage to residential or government/city has to be reported as well, at the scene not within 24 hours if I remember right.

Sorry to hear.
Get pictures. Get stuff in writing. Judging by the towing company's response, it sounds like they might try blowing you off. C'mon, they already admitted that they dropped the car and then they turn around and say it's YOUR fault because of the exhaust? That's :bullshit: . I would be concerned that they could turn around and say you were street racing or whatever and try to screw you around if the police got involved. Make sure you got your ass covered. Best of luck. Definately call a lawyer asap and file a police report (or inform them what happened and let them confront the tow co. for not reporting an accident). And yes, photo's photo's and more photo's. Mail box, car, tow truck, whatever you can.

I can't believe what some people will say and do to try and get out of something that is clearly their fault. If they couldn't or didn't know how to tow it then they should have just called and said we don't feel safe towing your car. At least you can then just get someone else.

Secondly how fast was he going when he hit the bump? The parts that hold the wheel to the truck fell off? WTF?? Sounds like incompetance to me.

Yeah get the lawyer. File a report with the police. Hopefully they don't start lying through their teeth about it.

Call a lawyer. And go back in time and refuse to go to that specialist, lol. That's rough luck though. And it's totally the fault of the driver because he could have moved the car and hooked it all up properly.. the fault of your exhaust? Yeah, right. :rolleyes:

Just a tip for anyone on the site with a modified car: Any time you need to tow your car anywhere, make sure you ask the towing company if they have a flatbed. I would highly recommend against towing with a regular truck.

To the OP: As stated above, pictures are key so head over to where the vehicle is located now with your digicam and an empty memory card.

also call the bbb and put a complaint through, like everyone said, call a lawyer, report this to the police and on top of that get the bbb involved. if they did something like that and are trying to blow it all off and try to put all the blame on you. get the bbb involved and try to get their business license revoked.

thanks everyone for the input... i think i am going to go to the police... you know i talked to the guy at first and i thought yo know accidents happen so i was gonna be nice and try and settle this on our own... but hes pushed me to much... i shall keep you all updated!

First off these guys that don't take responsibility for their own actions and try to weasel out of it don't deserve the gift of life. However since murder is illegal in our society, i suggest going to a lawyer and fuck these guys up as much as possible. I would personally pay a lawyer just to see these guys burn regardless of the cost. It would be my mission in life. BBB, Newspapers, Internet, anything i could think of.

It seems like these type of incidences are becoming more and more commonplace in this city. People trying to get out of assuming responsibility for their actions. I hate these type of people more than anything. They're the scum of the earth.

And what you can do about it? Nothing nicely. Hardball is the only way anything gets done now a days, unfortunately

Couldn't you talk to your insurance about the accident? They should have their own lawyers to deal with it. Unless insurance doesn't cover accident when your car is being towed.

Haha, sorry but it's kind of funny... anyway screw this guy and his solutions! They're at fault, and they have insurance for this kind of crap. DON'T take it to his guy to fix as it will obviously be the cheap bare minimum fix kind of thing... I'd start with the cops tell them what happened and then maybe a lawyer or call your insurance and tell them your car is smashed, they may go after the towing company's insurance for you.

ALWAYS go through insurance (especially when a business is involved)

We always took our work van to the Mohawk on Mcknight, right on the airport (because it was close and convenient, one day they're lowering it from the hoist, and left the door open, door hit the top of a toolbox, and no one noticed, and kept lowering it, tore the bottom hinge right off.

The manager told us he knows someone who would fixed it right up, without going through insurance. My boss, nice guy that he is, said ok no problem. The door repair was good at first, but in the past year has been getting worse and worse, the door doesn't hang right anymore, it doesn't seal right anymore, and squeeks like crazy.

There's nothing we can do either, since it wasn't taken through insurance, we can't go back to get it re-repaired.

*UPDATE!*

As directed by my insurance company I was to call the towing company to get there commercial insurance information... So today I had called for the person in charge of this, (who's name and cell phone number I have) 7 TIMES!!! Yes that's right seven times... Leaving a message for him to call me back each time, and yet nothing... I started this at about 10 am this morning and I made my last and final call at 7:30...

First couple calls were a few hours apart and for these he was at lunch, next couple he stepped out, next few he was in a meeting, then again he stepped out missing my call once again, then finally on the last call he had gone home for the day... Even if he was to be going home he could have called me none the less no matter HOW tired he was...

You can be assured that if I don't here from him TONIGHT! The BBB shall be involved by tomorrow morning... It's been almost a week and nothing has been solved yet...

well my last call went a little something like this...

Hi this is Josh calling again and I was wondering if I could speak to gary... no sorry he's gone home for the day... ic well can you tell him that i have been trying to reach him several times today leaving several messages to call me back and still nothing... also my insurance company says that if i dont get his insurance information by tonight the BBB shall be getting it tomorrow... and she replied with ok i'll tell him...

about 15 mins later i get a call from him saying o hey josh ya i just got back to the office and i got your messages... why do you need our insurance information... i then tell him my insurance company needs it... he then tells me that if they need it they can call him... wasnt to happy that he STILL refuses to give me ANY information... i then say ok have a good night bye...

now tomorrow we shall see how things go...

did you file a police report... the police will get you his insurance information for their report. and if they never reported it, i'd make sure the cops knew about that too, and they'll make sure that these guys fill out the paperwork

^^^^ I agree with above poster. There must be some sort of law about with holding insurance information if you are in an accident. I would go to the police station and file your police report with YOUR verision of events before they do. The cops will probably just have to make a "friendly" phone call to the tow shop.

i mean getting your car towed when your parked at an unpaid meter.. and having it damaged.. oh well can't do much


but shhhhhaaattt you called them to tow your car. they should take damn good care of it for how much it costs to tow a damn car...

police report, sue! own them good!!!!

damn if you don't we can just own them by calling in and saying we need a car towed at so and so... and just waste their gas.

Sorry to hear that man, Its not even my car amd I'm pissed... I wouldn't take my car to his specialist.. For all you know he buddys with the tow guy.. Go to the police, call your insurance, call a lawyer and ask the tow guy for his insurance info..
