LOS ANGELES, California (CNN) -- Paris Hilton was let out of jail Thursday morning, days after she began serving what was to have been a 45-day sentence for violating probation, a spokesman for the Los Angeles County Sheriff's Department said.

Hilton must wear a monitoring bracelet and remain at her home for another 40 days, said sheriff's department spokesman Steve Whitmore.

Medical considerations "played a part" in the decision to offer Hilton home confinement for the remainder of her sentence, Whitmore said.

Wonder if the medical conditions are "enhancements." haha

You guys are whacked bitching about celebs being above the law. She was a target for prosecutors to be made an example of and her sentence was completely unfair. We see tons of DUI folks keep driving, get busted, get fined, that's it thanks to overcrowding. Nobody sees jail time till they kill someone, or at least get busted drunk 4 or 5 times. How many times have we bitched about that on beyond saying the justice system failed with every DUI accident with innocent victims?

Paris got busted for 0.08%, the minimum for a charge... I've known ppl that's had 2 beers busted at 0.08% and usually those get thrown out because of equipment accuracy. Judges here always throw that out... much like 5 or 10 over speeding tickets. She got busted for speeding with a suspended license. Now, if you feel that deserves a 45 day jail sentence, you're seriously on crack. We'd have 50,000 more ppl in jail today if that happened to everyone.

If anything, she was unfairly punished for BEING a celeb.

That's what I've been saying the whole time. The only reason she went to jail in the first case was because the Judge wanted to make an example of her. A 30-day prison sentence is extremely excessive for a case like this, it's even more excessive when you consider the overcrowding in prisons. Sure being on house arrest in her fancy house is considerably better than being in jail, but how many regular civilian offenders get the same reassignment but we don't hear about it? The way I see it, if she had done the 23 days for good behaviour, which is legally required, and gotten released, there would still be a lot of outcry about her "special treatment."

And you think giving her a fine would stop her from doing it again? Admittedly a 45 day sentance was harsh, in fact jail time at all was also harsh. Personally I would have put her on one of those weekend highway clean up crews for 3 months.

She's only been busted for DUI (questionably too) once. The 2nd arrest was for driving with suspended license. She did a breathalizer and came up clean. The jail sentence wasn't to make her "not do it again", she never did it again that we know of. It was to make an example of her.

Like I said, the usual punishment would've been fines, and for an average joe, he/she would do it again anyways.

But, I believe she deserved it! All her life she been spoiled over and over again. She has no education and living off her rich parents/grandparents. She been abusing the law since she made a home video of her sucking one of many guys. So many people blammed Paris of being too much of a party girl.

The judge did the right thing of sending her to jail, since if the judge didn't do it then Paris wouldn't have learned her lesson, I believe she did.

Hopefully, when she was in jail she actually learned how to live a life without having 200+ servants serving you hand and toe.

If she goes on partying and driving while drunk and perhaps killing someone in the process then I guess maybe then Rage2 and others will understand why people don't like Paris?

Its kinda like a saying "Its all fun until it gets serious".

I have lost two friends who died needlessly due to drunken driver who slammed their car into a building a few years ago, he got off scott free. I am all for the LAW who actually do stuff against drunken drivers.

I think this chick is a lot smarter than most people give her credit for. I base this opinion on the fact that she has made millions by doing nothing really noteworthy, she does whatever she wants, whenever she wants and seems to able to skirt the law at whim. How many of the posters who hate on her can do the same?

Her family is wealthy but she was not born super rich as most believe. Certainly not to the point where the public believes she is at. She has publicists and handlers that basically made her into a publicity machine and has cashed in big on her opportunities.

If I was rich and if I was crazy enough like her, I can do the same. But I was born in a poor/low middle class family and was thought self-responsiblity. I bought my own car with my cash so I know how much the value is. Most kids these days get free cars from their parents and they don't understand the value of the car...

As long as she learned her lesson which she did...I think they shouldn't put her back into jail.

She was born super rich...

I believe her father rick hilton was a minor shareholder in Hilton Hotels. Conrad thought people should make money on their own, the old fashioned way. When he died he didn't even leave anything to his family but that was eventually contested.

Regardless of how much she gets it is still in the multi millions and her parent's are multi-millionaire's so I would qualify that is extremely wealth if not super rich.

I do agree with you about her being smart though. No idea if she is exactly as she acts in the Simple life but she has done nothing but spun off the attention she gets and turns it all into more fame and money for herself. Product lines, TV shows, books, anything she can get paid to put her name on. So why shouldn't she keep acting that way if she keeps getting paid for it.

Heh, she deserves it. I managed to find the full "timeline" of her offences, in case anyone still thinks they are going out of their way to make an example of her:

1. Sept 7, 2006: Arrested and charged with alcohol-related reckless driving. Pleaded no contest to a reduced charge and received 36 months probation, alcohol education and a $1500 fine.

2. Jan 15, 2007: Pulled over and was found to be driving with a suspended license. Upon telling the cop she didn't know her license was suspended, the cop searched the car and found a letter signed by Hilton in her glove box stating that she was not allowed to operate a vehicle. Nothing really came of this one.

3. Pulled over AGAIN, and FINALLY charged with probation violation for operating a vehicle with a suspended license.

I'm sorry, were your two warnings not enough? Three strikes and you're out! :thumbsup:

I know guys that have been sentenced to more time than that for violating their probation once (not to mention twice, like she did).


I'm going to laugh my ass off if this little stunt ends up in her being put in the Mental Hospital. Those will be way worse conditions than the private cell she had in prison...

I could be wrong on this, but I believe the original sentence was 45 days. They then reduced it to 25(or something like that) days because of "good behavior". She served 3 days and and was given credit for 5. She was sent back home by the sheriffs office on the condition that she serve her full 45 day sentence (credited for the 5 she already served). The judge has sent her back to jail as he never approved sending her home, and I don't know if it's back up to the full sentence but I believe she just has to stay there for the remainder of her 20 day(or so) sentence.

L.A. County Sheriff Lee Baca claims there was simply no room at his jail for a "low-level offender" like Paris Hilton -- and her "severe" medical problems were only getting worse.

In a statement to the press, Baca said, "There's 20,000 inmates -- the largest jail system in the United States ... It's very overcrowded."

According to Baca, 90% of the inmates in L.A. County jail are serious felons -- many held on murder charges or attempted murder charges. Paris was one of the "low level" offenders -- who usually serve 10% of their sentences.

Baca also said that he reassigned Hilton based on "her severe medical problems," and confirmed TMZ's original story that her condition was mental. Baca said that her "increasingly deteriorating problems" were evaluated and added, "This lady has some severe problems."

Baca added that she was medicated when she originally entered the jail system ... and "I can't trust her tenuous status," referring to her mental state. "She had a severe problem," said Baca, "I need more cooperation from the courts and from the city attorney's office."

For now, Baca says he will comply with the court order and keep her behind bars -- "If there's any further deterioration, hopefully we'll be able to address it."

One of my relatives had 2 DUI convictions, 1 hit and run conviction (it was a lawsuit scam but still...), AND got busted with changing seats while car is moving cuz he was driving with a suspended license and tried to get away with it (he got the driving suspended license charge too). One of them was a criminal charge, and not even close to any jail time haha.

In US and Canada, you pretty much have to injure somebody driving while drunk to see jailtime. Paris went to a dinner, had a glass of wine on an empty stomach, and blew a 0.08, the minimum level for a conviction (usually thrown out).

If you look at the california DUI charges, you'll see that the judge just wants attention and threw the book at her:

She got the restricted license, so she was allowed to drive to and from work. Of course, her line of work is debatable, because her job is to show up at places and get attention, that's how she makes her money getting media attention. So the judge fucking throws the book at her and says she wasn't working. Look at those DUI penalties... 2nd DUI = 96 hrs of jailtime, Paris gets 45 days.

Then she didn't even get released from jail, even tho she qualified to due to overcrowding. The average joe does 10% of their sentence on violating DUI probation, or 4.5 days. She did an equivilent of 5 days, and was sent off to do the remaining time in house arrest. No, that's not enough for this judge and prosecutor... wants to get in the news.

If you hate Paris Hilton, fine. Don't use that as an excuse to say that her sentence was fair.

If I was her lawyer, I'd definately throw a lawsuit at the state of California after it's over.

The penalty while more than normal, still less than the possible 6 month jail time but more than the minimum is 5 days (which is probably why she got out on the 6th). I'm sure the judge got all that covered. What they USUALLY do isn't written in stone, the law is.

The judge is getting attention but he also got his bases covered.

Remember, she isn't in jail for DUI. She's in jail for driving while revoked. I agree that the definition is vague for someone like Paris.

I know. Her license was restricted (work usage only). Any other person would've gotten a ticket + fine + longer license suspension/restriction and high insurance premiums, not jailtime. Another DUI, now that's a different story.

Sorry Rage, but I still think she deserves it. Not her alone mind you, I think the penalty for drinking and driving is not severe enough in general. Over the summer my girlfriend's cousin was killed by a drunk driver, and he never went to jail.
The sad part is you are defending her for blowing a 0.08. It might usually get thrown out, but I don't agree that it should be. Anyone should be convicted for that.

Paris Hilton will end up serving more time behind bars than the vast majority of inmates sent to L.A. County Jail for similar offenses, according to a Times analysis of jail records.

Whether Hilton received special treatment from the Sheriff's Department has become the subject of much debate since Sheriff Lee Baca last week allowed the hotel heiress to go home after less than four full days in jail, despite a promise that she would serve 23 days of a 45-day sentence.

The Times analyzed 2 million jail releases and found 1,500 cases since July 2002 that like Hilton's involved defendants who had been arrested for drunk driving and later sentenced to jail after a probation violation or driving without a license.

Had Hilton left jail for good after four days, her stint behind bars would have been similar to those served by 60% of those inmates.

But after a judge sent her back to jail Friday, Hilton's attorney announced that she would serve the full 23 days. That means that Hilton will end up serving more time than 80% of other people in similar situations.

The findings came as some critics accused Baca of showing favoritism to Hilton and as the Los Angeles County Board of Supervisors launched an investigation into whether the multimillionaire received special treatment because of her wealth and fame.

The data also underscore the profound effect of the Sheriff's Department's early-release program, which sets inmates free before their sentences are up to ease overcrowding.

Before the early-release program began in 2002, inmates with cases similar to Hilton's were sentenced to terms that amounted to an average of 23 days, the same as Hilton is expected to serve. They actually served 20 days. After the program began, the average term was 14 days, with inmates actually serving an average of four days.

Because of the high media interest, Hilton was one of only a few inmates whose premature release received publicity and the judge who originally sentenced her noticed. She is believed to be the first inmate in years who actually was sent back to jail to serve more of her term.

"Twenty-three days would be considerably more than the average person given her sentence would actually serve," said Stan Goldman, professor of criminal law and procedure at Loyola Law School. "The jails are so overcrowded that even though overcrowding is not the reason for her release, it colors every release decision from the jails system."

Baca's release of Hilton because of undisclosed medical problems touched off a storm of protest. Last year, the department released only three inmates on medical grounds, a spokesman said.

One of the most vocal critics, civil rights activist Najee Ali, said Wednesday that Hilton ought to be released if inmates sentenced for similar crimes were serving less time. He continued to criticize Baca's decision to cite medical problems for the release, but added that only dangerous offenders should serve their full sentences given the jail's need to limit overcrowding.

"Clearly, her violation is not as serious, so she should be released," said Ali, director of Project Islamic Hope. "The rules of fairness should be applied equally."

Hilton was sentenced to 45 days for violating probation on alcohol-related, reckless-driving charges from an incident in September. Police stopped her while she was driving during the period that her license was suspended.

If Hilton does serve the 23 days, she will have done about the same amount of time as 4,000 inmates who since 2002 had been charged with assaults, as well as more than 1,800 charged with burglary, more than 2,600 charged with domestic violence and nearly 11,000 charged with drug violations.

Over the last five years, more than 200,000 inmates have been released early. Baca started the releases during a budget crunch that he said left him no choice but to shut large portions of the nation's largest county correctional system. Though economic times have since improved, a federal court has ordered his department to reduce chronic overcrowding in the jails, hampering efforts to keep inmates longer.

The Times' analysis of jail releases found that more than 60% of those with cases similar to Hilton's walked free after serving less than half their time. Under the department's current guidelines, Hilton probably would have served even less time. Most nonviolent female offenders sentenced to less than 90 days are released immediately.

"The only special treatment she got she got more time in jail," Baca said in an interview earlier this week.

(The analysis studied only jail release data and did not take into account other factors that influence individual cases, such as the judge's sentencing record and courtroom behavior of the defendant).

Los Angeles County Superior Court Judge Michael T. Sauer made it clear when he sentenced Hilton that she was not to be released early. His comments were included in commitment papers the court sent to the jail.

Lets see she violates probation when she of all people could easily hire a driver for the few months her license was suspended. Gets caught and now last I checked she has national attention up the wazoo again. I noticed 2/3 of the top Diggs for the week yesterday were Paris related. Something about a book about her time in Jail? Even is she does 23 days in a county jail thats nothing compared to the publicity she is getting.

That may be true now that she has become a house hold name, but I seriously doubt she was paying her own bills in the early years. Any way you cut it she comes from a wealthy family, and that definitely helped her along her way. On a side note, Paris Hilton is everything wrong with society, being famous no longer requires talent, skill, or any valuable thoughts or actions. I dont blame Paris for this horrible societal travesity (as it is in fact society who created her), but she still makes me want to fucking vomit.
