I purchased an item from a seller in the states and it was shipped to me. The item was later stolen and covered by insurance. The insurance paid the seller for a new item, so is this new item subject to taxes?

The item is the exact same product.

It should fall under the same category as warranty repairs, which aren't taxed, but it needs to be properly documented when crossing the boarder.

yeah, if you already paid the taxes once, you dont need to pay them again, just have him mark ont he box "No Cost Warranty Replacement" and they should not charge you... you should not be paying taxes twice for the same item.

I just went through this with fedex for a warranty replaced hard drive, which was a no cost replacement, they tried to charge me the taxes but i told them how it was and they cleared off all owing amounts on it. ($10.something)
