hey if anybody sees a yellow ford probe with a black hood can you call 238-6906 please?

heres the story (partly my fault)

im selling my ford probe and this guy offers me 2000$ as asked so he pays me a downpayment of 400$ and comes back with a cheque the next day for 500$, he takes the car because he says he wants to work on it (not running condition) and will pay the rest 3 days later when he gets paid so i figured sure why not (thats where i went wrong) cashed the cheque and it bounced so i only have 400$ and he promised to come back and its now about 3 weeks later and he has not come back and he refused to answer his cell phone (i leave voice mails every day) and does not respond to emails, i called ama and apparently the car has been recently changed to somebody elses name and is registered and insured but the thing is i didnt give him a bill of sale or anything so how could he have done that?

and the car is running now, i saw it just today but was on deerfoot heading the other direction if you can keep your eyes open id greatly appreciate it

If you have legal ownership of the car (a past bill of sale or w/e) go down to the registry, bring your bill of sale. Talk to them, show them the bill of sale, make up some story about how you need to confirm your address and try to get the guys address from them, then go get the car yourself.

Call a bailiff, it will cost you some money, but the bailiff can seize it. Check for liens, if there isn't one on there yet, put your own lien on there. If there is a lien, still put one on. You should be able to claim ownership under a "purchase money security interest", but you don't have unlimited time to do this.

Hire the bailiff, he'll go out, find it, and tow it for you. It will cost you some money ($500-$1000, probably), but since the Probe left your possession not running, and now it runs, you'll lkely make out okay...

Good luck.

hey, thats actually a really good idea with the bailiff. dont you have to have a bit more info then that? like a court order or something?

you know its bad when I can't even trust lending someone $40. Most of the time you have to bug them about it to finally get them to pay you back. NEVER trust anyone, especially with money and if you really want to help someone by lending them money (or releasing a car in your case) then ask for a fucking collateral thats worth the same amount of more, i like to have insurance. Just my 2 cents.

Did you give him a signed bill of sale when he brought the $500 check? If not, then there should definitely be grounds for police to take action on. If you DID give him a bill of sale, I'm thinking your only option is small claims court.....

I don't mean anything personaly by this OP and I don't mean to insult, but what the hell were you thinking? I can't believe how stupid some people can be when they are selling a car. Can you go to a used car lot and give them less than half the asking price and drive away "in good faith" that you'll come back later with the rest of the money? I didn't think so, so why would you let some stranger (especially one that looks that inbred) do it to you?

I honestly hope you get through this without taking the whole shaft on it and I'm sure you've learned your lesson now but come on man, what were you thinking?

Let this be ANOTHER lesson to everyone else, pull your head out of your asses and quit making live easy for cheatin' stealin' lowlifes.

Ill keep an eye out in the NE, that car is so easy to spot, not alot of yellow probe's running around.

Seriously, have you called a bailiff yet? You'll have to swear out a warrant and pay him some money, but at least you'll get the car back. The longer you wait, the less likely the bailiff will do it, and you'll eventually have to resort to a civil claim, which is a pain in the ass and takes a long time - plus your car will be long gone by then, and good luck actually collecting the money.

This is probably your only option.

If he does have a signed bill of sale the cops WILL NOT classify it as stolen. They will file a fraud report and pass it on to their investigator.

Smalls claims or negotiating with the guy directly are your only options.

Sorry to hear about this. I'm currently in a similar situation with a different imbred fuck from Olds. As mentioned above.

he put hyundai rims on it and i also noticed a 4 inch muffler now and ya its likely spray painted another colour

Is there some piece of the puzzle you're not telling us?

He took your car w/out paying for it or getting a bill of sale.

How is that not actionable by the police?!?!?

CPS probably cant do anything unless the guy is in Calgary. if you have the guys last name try and find him via whitepages.ca

or just call the olds rcmp:

Olds
5110 - 65 Ave
Olds, AB T4H 1L8

(403) 556-3324

edit: and when you report it dont say you gave him the keys or some crap like that - tell them the truth , this fucker stole your car, he gave you a deposit (which bounced) and said he was going to bring you the rest of the $$$.
