I was involved in an accident at an uncontrolled intersection in a parking lot, and i was to the right of the guy putting me in the right of way.
so we collided and caused some damage to his car, and some to mine

how will the insurance company classify this?
is he at fault paying for my damages?

i believe that if it is a parking lot accident then the insurance will go 50/50

parking lots accidents are usually 50/50.
in some rare cases if you have several witnesses that can verify that HE was at fault. then it might not be 50/50

i got hit in a parking lot, cops made it 100% his fault. there were witnesses in both cars and they all lied but got caught in a lie...if with witnesses you should be able to get it straightened out. But also it's same as any accident over a certain amount of damage cops need to be called.

my sister and her husband were watching and seen where the guy came from and how fast he was going... it was a T interesction and he was coming towards the end where he had to turn left or right and i was coming from his right...how would i be at fault for this period, if i was in the right away?
