So im driving home from work. Goin west on country hills just past the superstore, and a mini van cuts into my lane and slams on his breaks. So i hit my breaks and well sure enough i slam right into him. The car behind me moves into the other lane so he wouldnt hit me and the car behind him stops in time before hitting me. But the cars behind that one all hit each other. Anyways there was an accident up a head. Thats the reason why this accident happend. Anyways i think my car is written off but i wanna know if im gonna get dinged for this? I dont seee how it is my fault. If someone cuts into your lane and slams on their breaks. i know the whole hit from behind thing but would like to know what you guys think?

You'll probably need witnesses that the person ahead of you made an unsafe lane change otherwise you'll probably get charged with following too close.

Did this happen last night at around 7ish? There was a huge pile-up 2 intersections down from superstore, going towards Nose Hill.

Probably the best you can hope for is a 50/50, which if you both have collision, doesn't really help anyway, since both your rates will go up.

You'll need a very convincing witness. Sorry for your bad luck, I hate it when you leave room in front of you, and some moron zips in there at speed and hauls on the brakes.

he cut in my lane cause there was an accident up ahead and there was cars in his lane so he cut me off and slammed on the breaks. and then i hit him. and yea it was on country hills around 7

the cops told me that it wasnt my fault and that i shouldnt get dinged with it. so hopefully not. and i dont have collision which means i will be fucked

Unless the cop filled out a witness statement it won't matter. Seen this before where the cops at the scene assure you it's not your fault but then don't fill out a witness statement and the insurance investigators find you at fault.

yea right now im goin with its my fault. .even tho i know that it wasnt. but either way my car is fucked and his is goin to get fixed. so i have no choice but to part out the car and salvage whatever i can.

IMO it's your fault anyways.

You should leave enough room in front of you for any situation to occur, including somebody cutting in front.

How the hell does that work? Please explain how to "prevent being cut-off". If you are the only car on a 2 lane road, and some asshat flys up beside you, passes you, cuts infront of you and slams on his brakes, how would you "leave enough room infront"?

The proper term is "Undue care and attention" its really bad here, because really if you dont have a good witness report from others the insurance company looks at as you rear ended them and were not paying enough attention to stop in time. Total bullshit but better than ICBC. :bullshit:

most of my right side is messed up and most of his left side is messed up. he doesnt even have any damage. its just some scuffs on his bumper
