just curious, a dealership must pay off all liens and ownings on the car, before selling?

if the dealership doesnt pay and say someone bought a car from them, then try to resell it and found a lien on it. how would i go about this problem? should i get a lawyer invole if they dont sovle it?

Read your contract with the dealership carefully, I've seen shady dealerships throw stuff like this in their contracts and end up "at owners expense"

It doesn't necessairly mean there is money owing against the car, often a bank will have a lien against a vehicle and when someone pays out the loan, the banker neglects to send in the discharge papers or request the release of the lien and it just goes un-noticed until the vehicle is sold. But yes I am surprised that the dealership didn't check the title first.

Get the name and address of the lien holder and call them, ask them if they still have an interest in the vehicle-if they do and will not release let the dealership deal with it.

I would not stress about it, just go to the dealership that you bought it from see the business manager ask for letter of discharge. Sometimes the banks are really slow when removing the liens. Also if its on the Carproof they are always 2-4 weeks behind when updating current lien holders. You can do it yourself but there is no reason you should if you bought it from a reputable dealer.

so i called the dealership, came in with the history report to show them the lien. they say they get it resovle by end of the day.
if not resovle by end of today what should i do?

Not to alarm everyone, its been hmm couple months. i had someone interested in my suv, and he did a lien check and he was cool about it, he said he would wait till everything clears up before buying it.

After hearing all the stories on those guys i wouldn't be surprised if in their contract it stated any liens would be your responsibility.

Just relax like everyone else is saying. If this is somewhat of a larger dealership, I wouldn't worry about it. We had the same situation. Dad bought a car from Brasso Nissan and about 6 months later he sold it and surprisingly the potential buyer did a search and found that there was a lein on it, but we paid it out in full when we bought it. Called up Brasso, and got it sorted out within a couple of days. Just keep in mind the dealership has to contact other parties to get this sorted out and it's usually in the form of emails or voicemails that get returned when the other party feels like returning it. So it might take a couple of days.

the first owner sold it to his friend, then his friend sold it to the dealership. that where i bought the suv. his friend own the first owner money, and choose to just put the lien on without him knowing that he doesn't own the suv.

so i am in the middle and cant do anything about it.

So what does GofFC have to do with this if they sold the vehicle when there currently wasn't a lein on it? Doesn't sound like they are at fault for this predicament.

Exactly... and it was the friend that put it on thinking the other friend still owned it... so in reality, both you and GofFC are stuck in the middle of this. I feel dirty defending them, but I'm trying to fully understand this. If it wasn't GofFC that put the lien on and they didn't sell it with an active lien on it at the time, then really they are in the clear.

yeah so now me and gallery both parties are trying to solve this in each different way. the owner is being a prick. as for the lawyer, still dont know which one.

In order to place a lien on a car you must be a registered lender and or have the signed consent from the owner of the vehicle. There are basically 3 organizations that can put liens on cars. Banks, mechanic shops, and CRA. Joe Smith just couldn't go out and put a lien on the vehicle for the hell of it. The lien should have been registered to a finance company. Sometimes liens take time to clear and if the person at the registries or the owner of the vehicle doesn't do their duediligence to make sure the lien is taken off then it can sit there for years. It's not a huge deal, you just have to know how the system works to deal with it.
