I bought a car... and the guy forgot to mention it needed a salvage inspection.

It doesnt look damaged so it must have been repaired at some point but the guy wrote SOLD AS IS on the bill of sale, is there anything i can do or is it just one of those learn from your mistake situations??

thanks!

If its a private sale unfortunately there isnt much you can do.. sorry to hear about your luck.

the guy DIDN"t forget to mention it. You failed to ask, tough lesson.

ya, i figured that
so basically i just have to get the inspection and pay for whatever it needs?

there is no law saying he legally cant sell the salvage car without telling me?

ya thats what i figured,
someone just told me that maybe it was illegal and i could do something about it...
guess not.

its illegal for a dealership to do that, but if it is a private sale thats "as is" than your SOL unfortunately.

i'm pretty sure if there' important stuff like that that he fails to disclose you do have some recourse.

EDIT:
found something

http://transportation.alberta.ca/2818.htm

If you purchased a vehicle but were not informed that it was an out of province or salvage vehicle or that it was designated as non-repairable, you may contact the Alberta Motor Vehicle Industry Council (AMVIC) (http://www.amvic.org/main.htm) toll-free at 1(877) 313-3833.

hmmm...
that sounds like it applies to dealerships to do it though to.
ive tried calling a few places to find out but nobody really seems to know. any ideas where someone would be able to tell me for sure?

Thaco

call amvic.

ya i tried, they were really not 100% sure or anything... they never really gave me an answer.

the lady just kept saying they advise that the "buyer be aware"

kkkate..

Be thankful it's only $1100, if it was $11000 youd have a huge loss to swallow.

you can get an inspection done for the car
but its a pain in the ass!
they look for absolutley everything, theyll always find a problem, even if the car is straight theyll still screw you over
good luck with it, but from personal experience its not worth doing

Thaco

yeh, it'll cost you $100-$150 per inspection, whether or not it passes. (generally, some places may charge you full price first and then less for a reinspection)

kkkate..
08-18-2008, 05:37 PM
ya i know it wont pass unless i put more money into it, i was just hoping maybe there was some law where the guy would have to just give me my money back or something..

Thaco

just call him and threaten legal action, that's generally enough for them to refund you, people generally wont go through that much bullshit for $1100 car.

kkkate..
08-18-2008, 05:44 PM
ya, i thought of that, but if he is okay with the legal action I just kinda wanted to know if there is anything illegal about what he did..

Thaco
08-18-2008, 05:57 PM
I'd say you'd have legal action on false representation, but i could be wrong.

kkkate..
08-18-2008, 06:01 PM
but the legal action would probably cost me most of the 1100$ so its probably not worth it

haha ya good call.
thats what im trying to do.

its more just for my personal knowledge now if it is actually illegal, he is caving though he is really worried?

does anyone actually know for sure if this was illegal, ive heard it happens alot and with out of province cars to

Unless he is a dealer, he didn't mislead or lie to you because you didn't ask about the car's status. Dealers are required to tell you whether or not you ask.
So, really I don't think you can do much but take it in as a learning experience.

pretty much it's your word against his. if he's a person the fails to disclose that it needs a salvage inspection, I bet he'll say that he told it was a salvage. I'm not sure if it's illegal or not but, I think you're screwed here.

have you tried contacting him back? maybe threaten him, or appeal to him. hopfully he has a little decency.

another option is to cut your losses, and sell it for parts.

or baseball bats and friends.. hahahah

good luck man.. keep us posted

So i talked to someone at AMVIC and she basically told me what everyone thought... its illegal for a dealership to sell a salvage car and not say anything but in private sales it is buyer be aware and there is nothing that i can do...

inspection will cost you in the range of $400 depending on where you go and usually they are very harsh. you need to have pics of the car before it was fixed, during, and after, from all 4 corners of the car (12 pics in total). also you will need to fill out a form of all parts that were replaced WITH the contact info of where you bought them and serial numbers of the vehicle the parts came off of (if used parts were used)....if that does not sound harsh enaugh, they will also fail you if your front windows are tinted :banghead:

i would say deffinately go back and at least try to get your money back or something...it is always worth a try

If you don't go and try to get your money back, your going to end up in his shoes trying to ditch a salvage car.
