Alright, so i parked in a reserved parking downtown. Not my parking but i still parked there cause its always empty. The parking stall is in such a way that you cannot tow the car directly from there because its facing a wall and there is a small 1 foot hump to get into the stall.

Well I hear the car horn honking from my window at my work and I run downstairs and the fucken tow truck driver broke into my car to move it out of the stall to tow it. My car was sitting in the middle of the alley way. He said he is allowed to do this according to the City of Calgary. Is this true? Tow truck drivers can break into your car in order to move it to tow?

Anyways he ended up not towing the car and there was no ticket even issued. He left as i was moving my car into a place that did not block the alley way. Fucken douche...

Dude call me whatever i dont care... but im just a little angered about the fact that they can break into your car. I am well aware i was not supposed to park there. And a ticket is justifed, NOT breaking and entering.

this, say it was a different case and the car is either in gear, has the ebrake on or both and a firetruck needed the hydrant where it was parked.. illegally, they are allowed to do so and hold a license to carry slim jims, same goes for automotive technicians and of course locksmiths i think.

I was parked in a reserved spot last summer and got to the car just as the tow truck driver was getting ready latch onto the rear wheels. He didn't notice me approach my car so I just got into it and peeled off. He jumped a bit when the car started as he was by my rear wheels, but I figure if he hadn't latched on yet, so fuck him.

There also wasn't a tow ticket issued, and no parking authority near by... I thought the parking guys had to issue a ticket for your car to get towed?

Section 78 of the TSA... allows for forcible entry into vehicles to move them, get things out of them, etc...

and no, you don't need to be ticketed to be moved. They can simply move your car out of the way instead of giving you a $25 ticket.

to the OP and Super_Geo: why are you bitching that there wasn't a ticket issued? Would you rather have a ticket to pay in addition to tow charges? I'd be happy that there was no ticket for parking in a reserved spot

I have to second the fact that you parked your BMW in a reserved spot, and is calling the tow truck driver a douche for towing your car.

Could be worse, I knew this one douche, the spikey hair'd, musclebound, collarpopping Eurotrash type of guy who'd pound his system that parked daily in front of the loading only doors as a perminant spot in a complex in mission when he went up to slam his whore of a bitch.

He'd park his car with the handbrake on, assuming that if the trany itself would prevent the car from being tow'd, that the rear brakes would hold.

Well, he got tow'd and while I was watching on the balcony, with a big smile on my face, while the monster of a tow truck (a flatbed) with a ridiculiously strong winch, literially broke things while it winched it slowly up onto the flat bed.

The tow truck driver didn't even bother trying to slim jim the door or nothing...

the Alarm was blaring and everything, but the douch, who must've been deaf from all his techno, didn't even hear it.

The whole front end was basically lifted off the ground by the winch before , then finally hearing creek creek, snap.

Poor 740Li, but totally deserved.

Im not bitching about a ticket??? what are you talking about? I have no problem paying for a ticket where I'm at fault. In fact im lucky I didn't get one, but I just don't like the idea of how a tow truck driver can be inside my car and can possible ruffle through all my shit looking for a quick steal. I would rather have $40 ticket than a missing Ipod.

Not only can they break into it they can tow it by "any means necessary"

Ergo, unless you want him to throw a hook under your car around your steering members and yank the car out sideways you should be thankful he opened your door and moved the car out without damaging it.

I wouldn't park there again because if he comes out to tow you next time I am sure he will abide by your wishes and pull your car out using "Alternate" means.

Hello my name is Shawn and i drive a 2000 BMW 323i (this matters latter) i was driving My friends and I to deny's one night and pulled into the parking lot, and while cruising the parking lot, to find a decent space, BAM!!!!!!! i hit a ditch that was a slope ended by an eight inch wall where someone had cut away the pavement and this destroyed the front end of my car and also put a hole in my oil pan rendering my car un-driveable. this "Grand canyon" of a ditch was not marked or lit. so i was wondering if i had to pay to get the car fixed or if the property owner/ manager had to pay for the damages and if so do they have to take it to the nearest dealer to get it fixed,and if they do, do they pay for the transportation of the car, and a rental for me to dive in the mean time? The lady from the firm that owns the property asked me to get an estimate for the bmw but i would have to take the car to a bmw dealership for this and the nearest one is about 400 miles away.
This car is also new to me i have had it for three days up till the accident so not all the legal stuff has gone through but my fathers insurance company said that i am covered for thirty days so i can get my own insurance (not sure if this matters) the car is currently not in my name but will be as soon as i get to the dmv (also not sure if this matters) so in all of this rambeling the true question is ...... Who Pays, me or them.

i'd like to add to the thread that lots need to have private parking signs certain sizes and heights or else they do not apply.

not sure if anyone can confirm or deny this or find out the specifics, but it seems like everyone is too busy ripping into the op

If you're going to disobey a sign that you clearly knew about, don't bitch about the consequences. If you have to learn it the hard way, in this case the tow driver having the right to break your window to move your car, then so be it. Lesson learned, move on and stop bitching about it. it's the same thing with any law, you can't plea stupidity and pull the "I didn't know that was against the law, I didn't know if I did this I would get that" line. Don't expect sympathy for being a douchebag. Some people just have to learn it the hard way before they learn something. Hopefully the OP actually learned his lesson. To tell you the truth, if i were that truck driver, and i already had the car in the process of being towed, you would be following me to the holding lot to get that back.
I feel no sympathy for you, you got it easy. Why complain?

Clearly that "Reserved Spot" is of importance to somebody, otherwise your car wouldn't have been subject to a tow. Something tells me this isn't the first time you've parked there either.

+1 the only thing I have EVER heard (besides sirens) from my office is when the canada post truck drove into the restaurant across the street.

We have reserved parking under my office that people park in all the time. I wish they towed people more. We have people park in front of the garage doors to the building while they run into tims to get a coffee, I have more than once blocked someone in while honking and that person got pissed off (maybe it is because it is usually 6:00am) but WHY are you getting pissed off at me? You parked in where I have rights too!

Fuck.

Dumb complaints like the OPs are a good example of how common sense is becoming a rarity, especially in lieu of blaming stuff on other people... OF COURSE they can enter your car to move it if it's in a position in which the tow truck can't actually directly tow it.

Not all tow trucks can teleport cars into a proper position you know.

the only reason the (tow truck) driver would break into your car is to prevent damage by not dragging your car to get it out of the stall, it was probably too tight to stick dollies on it, so the tt driver would put your car in neutral, they can get into your car in less then 2 minutes an roll it out of the stall to prevent damage. since you are parked illegally and someone has complained the car has to be moved one way or another.
