Do you have his insurance information? Or can you not proceed through insurance since it has been so long?

If someones agrees to pay cash with me, i still file it with my insurance but i just tell them so they know what is going on. That way, if something happens like your situation i can still fall back on insurance.

Text him (and save it) that you need the money in your hand by Friday or you will have no resort to go through insurance. I believe you can claim for up to a year or two after the incident.

definitely get in touch with your insurance. it's not worth the headache to do him any favours when he's not being cooperative.

Good! He's the one that hit you, so why should you have to waste your time running around trying to get him the best deal possible? He inconvenienced you enough by hitting your car. You've already done him a favor by not going straight through insurance.

I would be very careful and weigh all the options - something similar happened to my dad years ago.

Got hit in a co-op parking lot (he was parked). Lady was all apologetic, said she's take care of it. 3 weeks later, nothing. He contacted her to give her ultimatum and next thing he knew she was denying everything, saying he hit her. Insurance would only appropriation 50% blame (even though her moving vehicle hit his parked vehicle in a parking spot) because of no witnesses, etc...

I just write this because it's more than possible he'll turn around and claim you hit him, then you have a big mess on your hands.

Agree with the above.. contact insurance and try to make the claim if you still can. Also, were there any witnesses at the time?

You said you exchanged information already, so just start a claim with your insurance and put a hold on it and tell them buddy wants to pay cash. Then leave a message or text for him with the claim number to pay up or it's going through insurance.

And regardless how you are going to settle a claim you should ALWAYS get a police report and inform your insurance company to cover yourself.

Did you take any pics when the accident happened? Also did you save any text messages or phone calls, do not delete anything on your phone, call history or anything! If he pulls anything around then show everything you have talked about.
