Who pays legal costs associated with buying a new home, is it the builder or the buyer?

For me closing costs were included with the price i paid for my home.

Yes - they usually are included if you agree to use the legal representation the builder uses.

(However, in the event of a dispute you need to go with your own representation)

My wife and I had to pay for our closing costs simply because we didn't go with our builders' mortgage broker. The additional $1k or so in legal fees costs us significantly less in the long run than the 0.5% higher interest rate their broker could get us vs. our own broker's rate so our decision was simple.

The first time I built was with a bigger home builder and the costs were included if we used their lawyer. The second time I built was with a small builder and had to cover the costs myself, even though we used the same lawyer.

you should have used a legitmate real estate agent Talies...hate to say i told you so.

It can go either way. It's in the contract who is responsible for the closing costs. If you catch it before signing, I'm sure you can negotiate it. When I bought 3 yrs ago with Cedarglen, they covered the cost, but stopped the next yr. Beattie Homes also covers the cost.

Shane covered my cost with their assigned lawyer and I get to choose my own mortgage broker.
