hey...this morning on my way to school, driving along at around 40kmh..i slowed down to about 5kmh at the stop sign but then accelerated again..and guess who was right behind me... so the cop pulls me over and hands me a 69 dollar ticket..never got a ticket for running a stop sign before...anyway i can fight it..do i lose demerits? thanks

You probably could have fought it if you had at least stopped (less than the full 3 seconds)... but by just slowing down, you're blatantly at fault and can't really fight anything.

You could try stopping at stop signs. You're liable to hit somebody one day just cruising through them.

And its 3 demerits for all moving violations.

Just pay up.

Like Kenny said, if you actually stopped, then you might have a chance to fight it.

I've never heard of this 3 seconds bullshit. I assumed that stopping just meant that your wheels ceased movement.

I had to go to court once with a fail to stop at a STOP sign. it is 3 seconds.

How did you pass your drivers test, thats an auto fail not stopping for 3 seconds.

You won't lose demerits if your charged as the Registered Owner of the vehicle, but you didn't stop. So there's no way you'll be able to win this :dunno: Unless you can convince the prosecutor that you did stop. If you want to try that you have to go down to traffic court and wait in line to talk to the prosecutor. He'll have your file with any remarks from the officer, so you might not want to say you did come to a complete stop...

Go down to the traffic court and talk to the prosecutor, it wouldnt hurt to try it. Pay the fine and full and see what they can do about the points.

Same as when you get a photo radar, they didn't actually pull you over and cannot prove who was driving, so they sent the ticket to the regestered owner of the vehicle...however, I dont know how you would pull that off if you did get stopped. the ticket is issued in your name, and no where on the ticket does it state what vehicle.

Sorry boys, I talked to the people down at the license registry and they said that the 3 seconds things was bullshit as well. As long as you come to a complete stop, (ie your wheels have ceased movement and you feel that 'jerk' forward) you may proceed. There is no 'time minimum' you must hold that.

Weird, I just checked the Alberta Highway Traffic Act (section 98) and the City of Calgary Traffic Bylaws, it has no mention of the 3-second stop rule. The city by-law (2)(1)(ao) states "stop" means "when required, a complete cessation of vehicular movement"

Can you imagine people everywhere stopping for 3 seconds at a four-way? Roll, stop. One-one-thousand, two-one-thousand, three-one thousand, go. I've never heard of that, and I did pass my drivers test. :dunno:

My driving with undue care and attention was in my name. But because of the length of time it took CPS to charge me, the minor damage involved and the fact that no officer visited the scene of the accident they let me off with following too close ($69) and charged me as the r.o. so I didn't lose any demerit points.

i think i stopped like 10 sec during my driving test~! just to be on the safe side :thumbsup: the best time to do it is when its slowing like hell haha! i was going like 20 no matter wat road i was in, and he cant take points off me cuz of road condition!!!
