I have a serious question and any advise on this would be appreciated:

I am leaving for a trip out of the country between Dec 11, to Jan 5th 2012 and I bought a townhouse for which the possession date is Dec 22, 2011.


Cardel homes is not being very accomodating and I have repeatedly informed them since March of this year that I have a month long trip planned in December... Well before the possession date was announced. They completely ignored my emails which I sent once every month reminding them about my trip.

Now they are being difficult and expecting me to take possession during my trip... how am I suppose to do that???

What are my alternatives??? How can I get them to extend the possession date to January 5th 2011??

Please advise!!!

Should have googled Cardel before buying with them. My personal opinion about them from the experience I had dealing with them is you shouldn't be shocked if it get's MUCH worse.

If you don't take possession then they don't get paid.

And I'm not defending them but why does everyone insist on sending emails..... it's easy for them to dodge and avoid emails. Pick up the phone and call them.

I don't think you can just 'not take possession' of the house. Read the fine print of your purchase agreement. My understanding is that once the possession date is scheduled by the builder, you have to take the property on that date or you face daily interest charges until it's paid. I can't remember exactly how the process works.

You can extend the date, though builders usually charge a fee for that.

According to my builder if I didn't take possession on that day (that I had to sign and agree to) then they would charge me a penalty plus retain the right to sell the house to somebody else.

But yeah, we had to sign twice regarding our possession date and I think the final confirmation was 2-3 months before possession. If you've known about this trip since March how did you get forced into this date?

You still have a lot of time to get your mortgage funds together and leave it with the lawyers. You don't necessarily have to move in, but you do have to pay for it. That will be in the fine print.

Enjoy your vacation, and when you come back you will have a nice new house to move into. :thumbsup:

but... in my opinion. I don't know why they can't wait. Move in dates are always pushed back when they need more time, but when you need a few weeks it becomes this big deal .

I did phone them... even before i signed the papers for purchasing the townhome, i told them to their face, not once not twice but many many times... and its only a matter of 2 weeks. I dont see why they are being so difficult about it. Their lawyer has all my mortgage details anyways... so its not like im running away with their money!!

I havent signed ANYTHING that says I accept the possession date. They have no written document with my signature accepting the date of possession... When they sent that letter 2-3 months stating "tentative possession mid december" I refused to sign it saying, As you know I will not be in the country during that time. We have to have a new possession date (2 weeks later) and then I will sign and accept.

So nothing has been signed from me stating I accept possession date.

Your purchase agreement has a clause regarding your acceptance of the possession date.

What did they say when you talked to them?

So have you received your "official" possession date paper yet? I believe that's not issued until within a month of possession; that's the one you sign. If not, that's probably why they haven't really dealt with your situation yet. From there, then you can negotiate with them on whether you're available or not.

I haven't received the paper but I've received the phone call to come sign the paper and I refused as I'm not in town and now they are trying to work around my leaving but keep insisting on power of attorney.

They are just trying to "negotiate" with you ... to get a date that suits them (and no consideration to you obviously).

Also sounds like (correct me, if I'm wrong) you are simply calling or emailing them and getting the lowest person on the totem pole so to speak. You should, nicely that is, ask to speak to their boss about the situation. "I would like to buy your home, but ... " and you can speak about the situation. Your request sounds quite reasonable to me and I don't see why you should not be able to get it ... not too big a deal - imho.

Chances are also, that the person(s) you are speaking to do not have the power to change a possession date or perhaps whatever else might be going on in the background (office politics and all ... maybe they are afraid to ask this of their boss - who knows what the situation may be? Maybe they have asked too many questions ... who knows ... ).

By moving up the ladder chances are you can get this changed.

So the negotiating tactic, if you will, is to keep moving up the ladder until you get someone interested in helping you out .... might be (shouldn't be but you never know), the owner.

The owner would have a vested interest in customer satisfaction and what people view their company as ... perhaps more so than others working under them.

Sales manager and/or construction manager will have the ability to move the possession date. Those are the people you need to seek out & communicate with.

I was on holidays during my possesion date and had my parents take possesion for me with Heartland Homes. Wasn't a big deal at all just had to fill out some paper work, so I don't see why you shouldn't be able to get an immediate family member take possesion for you.

It's well documented on Beyond and elsewhere that Cardel doesn't give a shit about customer satisfaction in anyway. For some reason they have no interest in repeat customers or customer referrals. I only wish I would have found more information regarding their business practices before we built our last house with them.

Finally after all the complaining and arguing back and forth... and not signing any papers... they agreed to give me the possession after my trip. Walk through and possession same day :)

All is well in the land of new home owners!!
