If its a parking lot then yes...

Unless you get an affadavit from other driver stating it was entirely their fault...

Gee, I have never been able to use the word affadavit before thanks man...

teh wife got hit in the drivers front fender by a guy who was backing down one of the "isle" ways and she got it repaired through his insurance, but that may have been because he admitted to is when he filled out his police report

This rule in the parking lots has always bugged me. Makes me paranoid of idiots backing out without looking or driving the wrong way. *sigh*

it is a strange rule.

That is a pretty crappy rule. So that means you can drive like a total ass, hit someone, deny that it was your fault and you're not responsible for your actions?

I've only ever been in one parking lot accident and the other guy that hit me had enough integrity to admit it was his fault. There needs to be more people like that in this world.

what about this scenario..... u're car is parked.... and u see some guy hit it... and catch him in the act..... is it still 50/50 even though u weren't in the car....

so in other words.... the other party hit a parked car.... is it still 50/50? or is it all his fault>
