View Full Version : Restructuring of Due Process in the Court system

Some of you may think this is boring so dont continue reading.

But Ive been thinking a lot lately about our court system and how it fails miserably on so many occaisions. More specific failure is in the way gang-related investigations are carried out. the gangs have it easy.. Witness sees something, if they report to police or go to court, they die. Whos going to risk their life to drop the dime on a gang who wont see 2 years in prison anyway?

Knowing very little about law and principle thereof.. I have still been trying to think of a way of improving the police/prosecutions ability to retain a witness without the threat of intimidation. Who wants to displace their entire life in Witness Protection just to turn in some scumbag?

If you might have anything to put into the issue.. please feel free..

But yeah, something needs to be done about organized crime.. I would almost consider Canada to be easier for organized crime than in the states.

It'll never work...

To protect witnesses, you need anonyminity. You can't have anonyminity and credibility, because you need to prove that your statements and testimony are credible. It works both ways too...

Defense can pull an "anonymous" witness, and make shit up to help the defense say with an alibi. Who's the judge/jury supposed to believe?

Basically, nothing can be changed in terms of witnesses, and forcing them to testify. Nobody's going to give up their lives bceause it's the right thing to do if the accused has enough power to fuck you over.

What can be changed is the gathering of evidence on the police side of things. Some of the things that the police CANT do is pretty ridiculous and lets a lot of criminals continue on with their crimes without a chance of getting caught.

thats just it.. and yes Canada is a haven for organized crime.. in that there is little experience with it.. Rudy Giuliani maybe? Or put cameras on every block and violate all privacy rights. Would it be unfair though to have some modifications to the law if the crime is deemed gang related beyond reasonable doubt?

In many cases, the witness's life is in jeopardy even if they don't come forward and testify.
