Does anyone know where Alberta currently stands on the issue of marijuana. I have heard that it is decriminalized and you can have up to a certain amount without getting a record?

Any help? We are curious.

A website would be great....

pretty sure it was never decriminalized anywhere in canada, could be wrong though

last i heard the bill fell through

remember decriminalization is a bad thing. right now it costs a lot of money to prosecute a casual smoker and isnt worth it. if its decriminalized, the CPS actually MAKES money, as they can hand out tickets left and right. they dont have the resources to prosecute everyone that gets caught, but they certainly have the resources to ticket everyone that gets caught.

The following are the Maximum penalties allowed under the Controlled Drugs and Substance Act and in some provinces like BC, it's unlikely you'd get these maximum penalties.

Possession

* For less than or equal to 30 grams of marijuana or less than or equal to 1 gram of resin: This could get you a $1000 fine, six months in jail, or both(for first and any subsequent offence)

* For amounts more then 30 grams of Marijuana or more then 1 gram of resin, if the Crown decides to prosecute the offence as a Summary Conviction(See Below) offence, your looking at a maximum $1000 fine, six months in jail, or both(for first offence).

* For subsequent offences, you looking at a maximum $2000 fine, 1 year in jail, or both. If the Crown decides to prosecute as an Indictable Offence(See Below), you can get a maximum of 5 years less a day.

* Note: The Crown can only prosecute by indictment if your caught with more then 30 grams of Marijuana, or more than 1 gram of resin.

Importing or Exporting, or Possession for Importing or Exporting

* This could get you a maximum of life in prison.

Trafficking, or Possession for the purpose of Trafficking

* For less than or equal to 3 kilograms of Marijuana or 100 grams of resin could get you 5 years in jail. More than 3 kilograms Marijuana or 100 grams resin could get you life in jail.

Cultivating

* This could get you up to 7 years in jail.


Summary Offence: a summary offence is an offence which can be tried without an indictment. In practice, this often means a trial without a jury, jury trials being reserved for indictable offences.

Indictable Offence: an indictable offence is an offence which can only be tried on an indictment after a preliminary hearing or by a grand jury. In trials for indictable offences, the accused normally has the right to a jury trial, unless they waive that right.

Proposed Marijuana Laws

The following are the are the proposed maximum penalties for Marijuana (Bill C-17)

Possession

* Possession of 15 grams or less of marijuana, punishable by a fine of $150 for an adult, $100 for a youth.

* Possession of one gram or less of cannabis resin, punishable by a fine of $300 for an adult and $200 for a youth.

* In cases of possession of 15 grams or less of marijuana or one gram or less of cannabis resin where aggravating factors exist, the fines are $400 for an adult and $250 for a youth.

* Possession of between 15 grams and 30 grams of marijuana. A police officer would decide if the person should receive a ticket or issue a summons for a summary conviction. The ticket fine would be $300 for an adult and $200 for a youth. The summary conviction penalty would be up to six months imprisonment and/or up to a $1,000 fine.

* The parent or guardian of anyone under 18 would be notified that the youth has received a ticket or has been charged.

Importing or Exporting, or Possession for Importing or Exporting

* Laws would not change.

Trafficking, or Possession for the purpose of Trafficking

* Laws would not change.

Cultivating

* an individual found growing one to three plants would face a summary conviction offence with a fine up to $5,000 and/or 12 months in jail

* four to 25 plants would constitute an offence punishable by up to $25,000 and/or18 months in jail on summary conviction or, if pursued by indictment, five years less a day imprisonment;

* growing 26 to 50 plants would result in a sentence of up to 10 years

* the penalty for growing more than 50 plants would be up to 14 years, double the current maximum term of imprisonment.

In addition, in cases involving more than three plants, a judge would have to provide reasons why imprisonment was not imposed where any of the following aggravating factors was found:

* a risk of danger for children in the building where the operation exists

* use of traps (set to protect the premises from intruders or police)

* use of explosives (for example, as a booby trap or to destroy evidence)

* use of land belonging to others (for example, farm land)

* operation creating a safety hazard in a residential area
