    Default Semi with a flat bed trailer drove into me. Now what?

    So ya, driver admitted fault and I have a witness that stated such.

    Car is a 2003 Civic Coupe with a book value of $3000. Damage is 3 dents to the drivers side door and the mirror broke off. Repair cost is $2500.00

    The truck company does not want to go through insurance and just asked for a payout. I'm good with that, so what do you think is a fair payout?

    well, same as any other accident, I would be very careful that you aren't having any health issues before you accept a payout. If you are sure, and you don't mind skipping insurance, I'd tell em you'll go away for $3000 in hand before August 1. After Aug 1, you'll go to insurance.

    Same thing happened to my sister earlier this year except it was a guy driving a taxi. I say "guy driving a taxi" because he wasn't the actual owner of the taxi, but his friend making money on the side with his taxi. Needless to say they were very adamant about not going through insurance. The repair was like $1300-1500 on a $2000 car (at best) so they just offered to buy the car off of her

    If it's $2500 repair on a $3000 car and you don't want it, see if they'll buy it from you hahaha

    No clue how to proceed, but I'm wondering about:

    -$2000+ dmg; did you file a police report?
    -Do you plan on repairing and continuing to drive the car? Again, repair at a shop will require a police sticker
    -If you were to write it off, how does that work? I presume you'd get questioned bringing in a wrecked car with no paperwork for junking.
    -Is there any damage to their vehicle that they can come after you for?

    Accepting a payout means they are trying to keep their record clean and protect the driver. You should use this for leverage and ask for a larger payout.
    Ask for $5k else just go to insurance.

    Some might call this dirty but if they want to keep the record clean they gotta pay the bribes.

    Pics of damage? were you moving or parked? mileage and shape of car?

    I'd agree with this. If you go through insurance, they are just going to write it off and pay you out anyways. Just offer to sell it to them for $5k, and haggle from there.

    Yes they are trying to keep their record clean and for that they are paying it out of their pocket. If you want to do the right thing go through the insurance company.

    I doubt corporate (assuming large trucking co.) would go for a number that high ..... perhaps 4k would be enough as it includes your time for search and purchase of a replacement vehicle.

    I ended up proposing a $3500 payout and the company accepted.

    Considering you can get another civic for 2000$, and probably 500$ for yours from a wrecker still, its a win.
