    Default Accident procedure

    A few months back my gf got into an accident. We tried to settle it out of insurance but the other party kept putting it off. Now they have filed a $2300.00 claim. My question is what should we go about doing we have not yet reported the accident to her insurance company. Also is there a way to still pay the claim out of our own pocket to prevent a rise in her insurance?

    Well, if they filed a claim, your insurance knows about it.
    Does she have collision coverage?
    If so, then she has to report it to her insurance company, otherwise, call the other company to file a claim. If they try to put you off telling you to go to your insurance company, simply tell them that you don't carry collision, so this claim does not concern them.

    That is of course assuming that you are going to claim against the other insurance company. If not, disregard that.

    Some insurance companies have a clause where if they don't pay out, you don't pay out. That is, even though there is a claim reported, if you compensate them for the damages they had to pay out, your insurance doesn't go up. Unfortunately, for $2300, you're probably better off to let it go through insurance.

    Also if they claim any bodily injury (assuming the accident was your girlfriend's fault), then it must go through as a claim through her insurance company.
