    Default Overtime hours

    My friend is currentely working for an oil company downtown (PetroCanada) and works a heck of alot of overtime hours, I would say around 1-2 a day.

    The problem is they are not getting overtime pay or time off for all that extra hours worked.

    Is this legal? Are they legally entitled to the pay?

    If you have any help or input that would be appreciated

    Is he salaried?

    His employer could be banking the hours instead of giving him overtime.

    Yeah he is on a salary pay.

    He started working there about 4 months ago, and right away was doing overtime, I wonder if he can still be compensated for those hours.

    His work actually said to him that they don't pay overtime, and that if you work it then it's on your own time with no pay.

    I wonder what the provincial government would have to say about this...

    If he is on salary it is probably worked in there, most people on salary don't get over time.

    Usually that is why your on salary, becuase it bennefits the employer.

    1-2 hours isn't bad though, like 8-5 or 6?

    Maybe he could do some at home, thats what I usually do if I need to.

    I did 80 overtime hours in one week due to a large project being moved up.... I'm salary and do you think I got to see any OT pay for that? Nope. They said I could take the time off instead... but if I did, I would have to work OT when I get back to make up for time lost, so there's no point.

    I too would like to know the true answer to this. OT is definetly not included in my salary.

    In my case, must the company pay out my unused OT vacation time at the end of the year?

    thats the shitty part of salary...

    but at the same time an hour a day is nothing...

    Some words of advice for your buddy: TRACK YOUR O.T. HOURS!

    Even though he doesn't get paid for them now, they may be used for time off in lieu or become a good negotiating tool later. If they're not written down, there can be doubt as to what the real numbers are. I've heard in some cases where laid-off salaried workers got some or all of their O.T. hours paid as part of the layoff package.

    If they said they don't pay OT, then THEY DON'T PAY OT. That is the point of salary. Yeah salary is good for those days you call in sick, or need an hour off here and there, but when it comes to OT, it usually sucks.

    You can get paid salary and OT. You just have to hammer out an agreement with your employer. What ever is in the contrat you sign is what they have to pay you. So disscuss it early and get an arangement you can both live with.

    I work 50 - 55 hours per week and an official company week is 37.5 hours. I'd never think of asking for OT. But I've gotten 2 raises, 3 granting of options, and a decent bonus in the last year.

    If you work hard and they should reward you with experience, bonus, options, and/or raises. If you're not getting compensated somehow for "extra" work, it's up to you to leave for less hours or more pay.

    Not like it's hard to find another job in O & G.

    I'm salaried and I'm also 'eligible' for OT. Basically if i work OT and want the hours i can charge them, but it seems they like it more if you just take time off instead.

    But i've hardly worked OT in a year and a half here.

    I work 10.5 hours overtime every week, probably about 300 hours so far this year.

    Same here, I'm on salary and put in over time here and there, mostly because I hate traffic and would rather come earlier and stay later. Within 7months since first being hired on, I've had 2 significant bonuses and a 25% raise. I don't even work for an oil and gas company, just a small distributor way down south.
    Someday we may need to activate the halo structure off Deerfoot and destroy the North East.

    I'm on Salary + Overtime, but rarely have to do any. I just bank them and use them like vacation or sick time.

    Last place I was at was salary regardless of hours worked...and when you're IT and have to go in at odd hours...yeah...sucks...

    If you're crying over OT hours, you're not gonna get far. I used to work 18hrs a day on salary, no OT. Eventually, I got rewarded with everything I have today.

    a couple of OT hours won't hurn anyone. Shows your are committed to finishing your work ontime. Usually doing this pays off in the end because it shows your committed work ethic.

    Ya most salary workers don't get OT. But an hour a day doesn’t hurt that much does it? Plus if you're busy it should just fly by. I'm lucky enough to get paid OT (European O&G). My boss is really lenient too and says however long you want to stay, stay. He doesn’t care how much OT you rack up. One of my coworkers makes an extra $1000/month in OT. I usually stay 1 hr as the train is too packed.

    I just can't wait to see how much of my OT the government will get their filthy hands on!

    Lol, I'm salaried AND o.t'd, I think I might work an average of 30 hours a week, but if I have to work anything outside my normal hours.... OT BABY, BOOYAH!
