Cheque bounced, what can I do?

I sold my Acura a few weeks ago, the seller is from Edmonton. He paid the majority of the money in cash, then told me that he'll get paid in two weeks for the rest of the money (just a few hundreds), so we agreed that he'll give me a post dated cheque for that amount so i dont have to drive up to get the money from him.

The two weeks pasted and i went to cash the cheque, it bounced and got me a little worry. So what can I do here if he refuses to give me the rest of the money? What happens if he has sold the car? Anyone i can contact for help?

Yes, i know i shouldve asked for the full amount blah blah blah. I've learned my lesson and shouldnt have trusted anyone. I'm just looking at some advice on what I can do at this point.

update: Nov, 8th

so here's the full story of what happened, long read but im bored so i have time to type.

I sold the car at the beginning of Oct, to a guy in Edmonton through 780tuners. His user name is 11laxboy11. I left him my contact number and he called me, telling me that he needs a car ASAP and was wondering if i can delivery the car up to him that very night. I did and we agreed on a price. While i was getting ready for the drive and looking for a friend to drive me back, he informs me that he only has 4500 in cash right now, and will come to Calgary on Nov 1st for the rest of the 500. I proposed to have a post dated cheque for that amount for Nov 1st instead, he agreed and off I went to delivery him the car.

So all went well, I got the money and cheque. He asked for the paper work of the motor/tranny/ new headgasket i replaced but I forgot them at home while i was cleaning the car out. So I told him i'll fax him the paper just call me to give me a fax number. A few days has gone by and no calls, he did call the company where i bought the motor/tranny from to verify the purchase was really there. And of course, everthing checked out with the company no problems at all.

So i thought nothing of it, he got what he wanted to vertified so all is good. A few weeks later when i went on 780tuners i found a msg from a weeks ago asking me for the paperwork. So i asked for an email and emailed him a copy of the paperwork for the engine and headgasket. His mail replied:

ok well i still need the tranny/battery papers i sold the car and i nee to give this guys proof of everything you said you had. and he wants it by tuesday so i will give you a fax number tommorow and i need you to send asap or i am out 1000 bucks. i dont mean to be a bitch about it or anything but if i dont get it by the 31 then i will cancel the cheque until i do. because i am not going to take a lose on this because of this.

so i replied:

Sure, give me your fax and i can fax you the battery warranty, as for the transmission, I'll have to ask XXX to get it on monday

The original didnt mention the tranmission but in fact they did come as one unit, The tranmission came free with the engine, and out of laziness i swaped both at the same time which was easier. So while i ask for a another proof that i got the transmission with the tranny, he never mailed me back with the fax.

Two days later i mailed him again

Got that fax number? I have everything here ready to go.

another day gone by, I mailed him again

Do you still need the paper? i can set you the tranny one but i cant scan the battery warranty. i'll send you that tranny sheet later this afternoon thur email then. Hopefully that can help you.

Then out of the blue i got his at 17:34:41

yea i need everything today actually well by six my fax number at work is broken so yea if you can get those scanned and to me tonight that would be AWSOME this guys has givig me already 3 weeks to get him these papers and he said he isint going to wait so i already counted my 1000 bucks gone

I sent him the paper work right away
(before 6), days later i got his:

no man it didint help me at all the guy stiffed me

Then he disappeared, I still went and cashed the cheque which bounced. Which im 90% sure he cancelled it... and heres where we are now.

see if you can find out why it bounced.
i.e.
"insufficient funds"
or
"account closed"
etc.

not that one is worse than the other, but with account closed you will know that he intentionally tried to f*ck you over.

goto the bank that the funds are being withdrawn from. they can put a caveat on the account, that the next funds deposited into the account are put on hold for you. I have had to do that before when i was in sales.

I'll need to talk to him still, just going over my options right now. Ya its not that exciting, its only a few hundreds. Sure i care about the money, even though its not alot, but if he thinks he can get away with it unnoticed then he's an idiot.

That's a major problem with Canada. In the U.S. writing a bad cheque is a felony, he'd be going to jail at one phone call from you to the cops.

It's a joke up here, there's nothing but a pathetic N.S.F. charge if you bounce a cheque, and legal recourse against another individual is rarely worth the time/money it would cost to recoup the money.

Did you get any of his info on the bill of sale? Anything at all?

Take any and all info you got to the cops and see what they could do for you, but the majority of the work is gonna come from you.
