    Default Traffic Violations and Fighting Tickets

    I was recently pulled over and recieved some tickets; I need some help. The two tickets I recieved were
    ~Speeding 30km/hr over the speed limit $177
    ~Failure to show proof of insurance $172

    Some things to know.
    I live in Calgary and was pulled over on Crowchild Trail Northbond.
    I was insured but I didn't have the proof on me.
    I think I was only going between 15-25km/hr over the speed limit.
    The cop was in a covert car and was tailgaiting me dangerously close (in my opinion).
    He pulled me over in an area that quickly changes from 60km/hr to a 70km/hr to an 80km/hr zone, he pulled me over just before I got to the 80km/hr zone and I believe I was accelerating to 85-95km/hr.
    It was late at night and there was few cars on the road but the ones that were there were going faster than me.
    And the cop said he clocked me at 100km/hr.

    So what I want to know is: What can I do to reduce these fines or completely eliminate them? What should I do when I go to the court? What are the current laws in Calgary and how do they help/hurt me?
    Any advice would be very helpful. Thank you.

    Yes I read that before I posted but it doesn't really tell me anything that helps. I was just looking for some help.

    just a warning... get ready for all the assholes to come out in droves.

    saying their smart ass shit like "uhh... dont speed?"

    Nobody on here can really give any good fucking advice because they are all pompous asses.

    But maybe god will send you someone with some decent intelligence to help you out today.

    I fought and won all my tickets at the rocky mountain house or whatever it was called downtown... but I dont think they have that anymore unfortunately. That used to be too easy.

    They still have it, they just moved the courthouse. It's like 5th and 7th or something... It's ridiculous the security... It's as bad as the airport, and the lines are even worse than before. Get there early, and I mean EARLY!

    You can get it reduced, usually to disobeying a traffic sign (172, 2 demerits) or you can go to court, and fight it. Try to pick a day other than what they suggest, as the cops usually take a single day off to go and contest all the tickets. If he doesn't show to the court date, they usually just throw the ticket out.

    Piece of advice, keep a copy of the insurance and registration in the car.

    I got failure to produce insurance, failure to produce registration (forgot em at home?) and failure to notify registry of change of address, i took them to the court house (with the papers) i showed the prosecutor or whatever you call them, and she threw out the failure to produce tickets and just made me pay the change of address one.

    Maybe she was just having a good day?

    Rob, calm down. It's a public forum, and he's entitled to his +1.. He's completely right about it as well. OP got his answer,

    Some people have told me that I should just plead not guilty at the court date. About 50% of the time the tickets just get thrown out because the cop fails to show up for the trial. If he does show up, (For the proof of insurance ticket) I will attempt to show that I was insured and try to play off sympathy because I'm a poor working student. For the speeding ticket I will try to convince them that I was in the 80km/hr zone and going only 95km/hr or slower (cop claimed that it was in the 70 and that he clocked me at 100km/hr). I will also tell them how he was in a covert car and tailgaiting me, and say I had fear that he would rear-end me as I have had bad experiences with people tailgaiting me. Also I will mention that it is my first offence. Does this sound like a good plan? Can any one been through the legal system tell me if its a good idea? And some some tips about going to the courts would be really helpful. Thanks.

    I dont know about the whole he was tailgating me part.. maybe leave that out.. Cops are "trained" to drive (supposedly better than we are). so the crown might not like that one to much.

    First of all, never admit being guilty, even an admission... I think your SOL on the insurance ticket. But for the speeding one, don't mention being 95 in an 80, it's still an admission of guilt. Just say you were sure you weren't going 100, and that you were sure you were in the 80, and that the cop tailgating you, and frightened you due to the reasons you just said. Just don't admit to being guilty of anything. The worst that'll happen when you go in, is that they make you pay it. You can't get it reduced in court, it's you pay it, or you get it thrown out. There is no in-between AFAIK.

    Your best bet, if your really worried, is talk to/hire points, or one of the legal students at U of C. From my understanding, they take on small cases like this for the experience. I'm not sure if it'll work in traffic court though.

    Trained or not, they do tailgate. All the time. Especially when they're running plates. It is scary... I had a ghost truck come up behind me going 30kph faster than me. I seriously braced myself for a rear-end.

    I do know that they tailgate all the time, my post above was supposed to imply sarcasm, but the internet and all i guess its hard to tell.. im just simply saying the crown might not like the fact that you are saying the cop is a shitty driver.

    Tickets can get reduced in court. I've been there and done it. It was an exhaust ticket. another story another time.

    Be sure to get your 'disclosure' from the crown prior to any trial. This will include a portion of the ticket you never got which includes the officers notes. These notes are admissible in court and are most likely the only thing to officer will have to go by in his/her testimony. Use these notes in building a foundation for a defense. Chances are he won't remember you, your car your speed or any details of the event.

    Its best you do some research into how a trial is formatted. You don't just go in and make your case.

    1. The prosecution will present their evidence. In this case most likely the only evidence they have is the officers testimony.
    2. You can then cross examine the officer.
    3. If there is no further crown evidence they will rest their case at which time you will present yours.
    4. Your case will most likely be only your testimony which has to be truthful. You won't be able to beat the failure to produce in court. He says you didn't have it and you can't lie. To beat the speeding you don't have to prove 100% that you didn't do it. Only a reasonable doubt to your guilt. Between your testimony and your cross examination of the officer you will have show it is possible that you weren't speeding or its possible he clocked a different car or perhaps he is mistaken about the speed of the zone you are in. Keep in mind though you can't lie.
    5. After you are done you rest your case and the judge will come to a decision.



    Good questions to ask officers are:
    Did you use a speed measuring device to determine speed or did you estimate it?
    Do you have any special training in the use and maintenance of such equipment?
    What certification if any do you hold in the operation of the device.
    Any question that starts with 'Is it possible' is good for reasonable doubt.
    Is it possible that the radar captured the speed from another vehicle?
    Is it possible that the machine was out of calibration that day?
    Is it possible that we had already entered a 80km/hr zone?
    Other than your notes on the ticket do you have any real memory of the events of January XX, 2008?
