    Not sure I'd agree that the damage isn't pretty extensive. My Xtrail got hit last year when it was parked (no frame damage, no airbag deployment, no suspension damage etc.), it didn't look as bad as those photo's do and the damage tally was over 14K.

    I'm not an appraiser but that's pretty extensive in my books. I wouldn't feel comfortable driving a car after being in an accident like that.

    I have my reservations that a body shop would be able to repair it and have it look exactly like it did before. Most people with an eye for detail would be able to see any misaligned panels or color differences instantly.

    If it were me, and insurance decided to repair it, I would sell the car the day it came back from the body shop.

    I can't believe I didn't notice this thread till now.

    I went through the exact same thing around 6 years ago! I let a guy test drive my car around the block and he ended up driving through a house within 30 seconds .

    In the end, he got a reckles driving ticket and my insurance covered all the damages. I got a check for my car but my but my insurance went up.

    That was one of the worst mistakes of my life, lesson learned.

    I'm sorry but there's nothing you can do but bend over.

    And this goes for everybody, DON'T EVER LET ANYBODY DRIVE YOUR CAR!!!

    no, as the transfer of keys from the bf to the driver implies an understanding of consequences on the bf legal side

    Will do. Although now with my insurance going up so much I think we are going to have to replace it with a friggen....like. cavalier

    Seriously....

    I talked to the driver and he still wont commit to anything. But there is a possibility he will settle with me on the side still. He realizes even if this isnt settle financially I will make his life a living hell for a long ass time.

    Also I paid 17995 for the car....plus all the financing charges through the dealership...plus yadda yadda...plus extra set of rims and wheels....

    Plus not to mention...How many people see SIRs with the Mugen body style? we paid for originality and a car that doesnt have alteeza lights and a bunch of primed ugly ass mesh fenders on a civic....

    I will post up before pictures so you can all see the gorgeous condition before the crash.

    I know we carry a 43R and a 43L endorsement

    43R is for financing vehicles and 43L is for leased (same thing pretty much, just gst isnt covered and a few other minor exclusions)

    Actually, in Alberta, there is an Absolute Liability Clause. Basically means that, an insurance company has to pay out to an innocent party, even if their insured had done something to breach the policy.

    If their insured has collision coverage, then they would just deny the drunk person, but not the vehicle that was obviously not at fault.
