    Default Insurance Settlement Question

    I was stopped at a red light downtown. Some asshat plowed into me with his '07ish Denali doing a good 60km/hr.

    I think his was a write off, the angle I was at and the trailer hitch saved me a lot of damage and ended up only being $5000 dmg for me.

    Witnesses were yelling at him for driving like an idiot, they thought he was on his cell phone or drunk.

    Dunno what he was charged with.

    My 12 year old daughter was in the vehicle, she's fine.

    I was in chiro treatment for the full 90 days for whiplash (WAD2 or something). I still go every two weeks, when before I went once a month.

    I lost many hours of work, and I bill by the hour, and I ended up not being able to lift much for a while so I always had to make sure I had help.

    I lost more than $4000 in wages and time, among other expenses like gas in the full size rental truck I had to drive for a month.

    So, my question. The adjuster wants to meet with me next week to discuss a settlement. What should I expect or settle on? I know they had a $4000 cap for soft tissue damage but that was up for contention...Is that still in place or was it removed?

    Is this the first meeting with the claims representative/adjuster person? Generally they'll just ask you questions on how you are feeling, what happened in the accident etc. They'll get permission to review your file and health report from the doctor and go from there. They'll call you usually on a month to month to check up on your status and when you are ready, you can settle up. The settlement is negotiable, they'll make an offer, you can counter etc.

    This is supposed to be the last meeting. She's a consultant to the insurance company so I'm not sure if that's better or worse!

    get your lawyer. and he will make sure that your rights are not being walked on. the insurance company is trying to save money now and pay out as little as possible. have someone that knows the system look out for you.

    But a lawyer will usually take 1/3 of the settlement? Or is that different where you have to go to court?
