    Default another "if it's too good to be true" lesson learned.. the hard way

    Well this is super embarrassing, but I really screwed up and now I'm out a truck and some cash.

    I would love some advice, because I've never dealt with this stuff before. None of my cars have even had a lien on them before.



    Story:

    well I owned a 98 GMC jimmy that is well maintained. And I needed a bigger truck or SUV, because more often that not, I was finding the jimmy too small for me.

    so I posted an ad on kijiji to trade for a full sized suv or truck.

    well some one replied with an 04 F150 ext cab.

    so I went to see it. thinking this was way too good to be true. But thought I’d see it anyways

    when I saw the truck the was major damage to the bumper and the car was a mess ( it took me over 8 hours to clean it). so some how I thought in my head that this was fair deal.

    so we traded the jimmy plus +$1600 for the truck.

    I did do a lien check and a lien popped up, I tried calling the finance company and they didn't tell me anything for it.

    I talked to the guy and he said he had one payment left on his extended warranty, so he showed me the coast to coast warranty receipt that showed the financing company that showed up on the lien. so I thought, if it was only the warranty, he couldn't have owed too much money.

    turns out I was wrong. he must have had a different loan using the truck, and yesterday morning I awoke to a bailiff taking the truck.

    tried calling him, and obviously no answer, and I went over to his house... and of course he's moved.

    so that's my nightmare



    the guy seem like a good guy, so I was stupid enough to believe him.

    now I have to go see about a civil suit, but I don't really know how to go about it. but I don't even have an address

    he's a car guy so I think maybe someone here might know him.

    his name is Bjay Pasutti, and hes' a big fella and probably driving my white 98 Jimmy 4door sls ( I know there are a million of them out there. and I'm not expecting any one to find him, but I just feel like I should put it out there.) he says he works as west jet's lost baggage return courier (which I assume is a lie too)

    I'm not expecting the financing company to do me any favours, so I'm pretty sure the truck is gone. but I'm expecting someone from their legal department to call me back to see what my options are.

    sorry for the long read, I just have no idea what to do, so I thought I'd share how stupid I was.

    At the end of the day, it is only money and I can recover from it, but can’t believe that someone would do this to another. Oh well lesson learned

    I will see if my house mate will sell his white 4 dr Jimmy to you. It has some minor work it needs in order to get it running, but maybe he could sell it at a good cost to you.

    The police don't care and can't do anything about it. You can try small claims but I bet they would say you knew about the lien so it is buyer beware. Never ever buy anything with a lien on it unless you can go to the financial institution with the owner and watch him pay off the amount owing. My dad got caught this way once and he ended up having to pay the rest of the money owing or the truck was going to be seized. Always run a lien check and walk away if it has one.

    Hey Wayne, how did you pay the guy? Cashier's check? If you did, his banking info should be pretty easy to figure out. Not sure if that helps at all though.

    This is why I buy cars that are worth practically nothing...lol

    shitty deal Wayne.

    You should have his driver's license info on the bill of sale. It is buyer-beware, but if he lied about anything regarding the lien, then he is at fault.

    hahah, thanks for the support.

    all the asskicking, house burning, car vandalizing thoughts have crossed through my mind, but I think I'll try and see what legal routes I can take first

    the lien amount was on the repo sheet, and it was $19,500, far more than the $200 he said he had left on it.


    but since I did do a lien search I might be screwed. but he did lie to me, I can see if that gets me anywhere.

    Lien check is $20. ALWAYS get a lien check when you buy a car, even if it is only $1000. I know this won't help the OP, but for everyone else, just do it.
