    Default Buying stolen stuff

So I am in the process of selling my iphone and am looking for a blackberry curve.

Alot of the ads on kijiji say 'multiple units available' or BNIB..obviously this is a little suspicious coupled with the fact that my friend at best buy said guys come in with duffel bags, shove the phones in there then get away.

I was just wondering what happens if I do buy one of these potentially stolen phones, If it is stolen what if somehow (techonlogy is crazy now a days) it gets back to me, what to the police do? Does having a bill of sale from the seller help at all?

I'm sure this happens at least once a day.

High Shrink items (laptops, phones, ipods etc) at Bestbuy/Futureshop are supposed to be secured behind the department desk in the cages, or in a locked display cage. There is usually only 2 keys on the floor at any given time as well.

So if someone managed to roll in there with a duffle bag and unload a store of more than 2, that just amazes me.

I used to work at a BB and a FS, and I can honestly say no one ever pulled that at either of the stores I worked at, it would be basically impossible at Shawnessy FS, Deerfoot Meadows FS and BB as well.

He's probably talking about the NE where the employees are behind bars and glass and the merchandise is out on the floor.

If you're aware, or have a strong suspicion that its stolen, then it's criminal to buy it. You can be charged with possession of stolen property.

    Having in Possession

Possession of property obtained by crime

    354. (1) Every one commits an offence who has in his possession any property or thing or any proceeds of any property or thing knowing that all or part of the property or thing or of the proceeds was obtained by or derived directly or indirectly from

    (a) the commission in Canada of an offence punishable by indictment; or

    (b) an act or omission anywhere that, if it had occurred in Canada, would have constituted an offence punishable by indictment.

Ask the seller for the serial number and call the cell phone service provider. If its not stolen they should not have an issue to provide it.

And if you do buy something stolen (without knowing), and the police find out they will take it from you, and you are out whatever you paid the theif.

To add, if you're not aware, or manage to play dumb, you still have no right to the property afterwards. You haven't bought anything until the owner sells it to you - if you paid someone that doesn't own it, it wasn't theirs to sell, so you're out the cash if it gets seized.

If the serial # is scratched off then you know why. Dont you need the serial # to activate a cell phone? I would get the serial # and talk to the cell company. If it turns out bad you can atleast report the person. Usually if a person is selling one thing, they got more.

By my interpretation of what you posted, it says "knowing" not "suspecting" so letter of the law would say you're okay.

That being said: "If it's too good to be true, it probably is"

    Don't risk it.

Seems like a pretty bad idea. I wonder how these guys are getting all the BNIB stuff all the time, because it may be legit sometimes. better than paying rogers 50% more.
