    Default Batons legal?

Are telescopic batons legal in Canada, or to be more exact here in Alberta?

I heard you can buy them from the flea market and some stores in China town but i wanted to order one from the states and was wondering if ill get hassled during shipping (customs)?

    Thanks

It's a prohibited weapon under the Criminal Code, S.91(2):
Unauthorized possession of prohibited weapon or restricted weapon

91(2) Subject to subsection (4), every person commits an offence who possesses a prohibited weapon, a restricted weapon, a prohibited device, other than a replica firearm, or any prohibited ammunition, without being the holder of a licence under which the person may possess it.
Part 3 of the schedule to the regulations define prohibited weapons, inluding the following:
    13. The device commonly known as a “Kiyoga Baton” or “Steel Cobra” and any similar device consisting of a manually triggered telescoping spring-loaded steel whip terminated in a heavy calibre striking tip.
So, no you can't have one of those. It's a crime unless you have a license to possess it (the exceptions in subsection 4 would not apply).

    Maximum sentence: 5 years.

its only illegal if you have when when you have commited an offense though.

There's the key right there. No spring or actuator, no problem.

And, as usual, carrying anything in Canada for the purposes of protection is illegal.
So, when asked, you carry it in your car because your starter solenoid sometimes needs a whack to get going, or some other such valid reason why you might have it.

God we've got some stupid fucking laws, and people, in this country...

    1) Self defense of one’s person and property is the number one inalienable right a human is born with.

    2) An automatic baton is Illegal, an ASP expandable baton is not. Different things. Also, buy an ASP for $100+, don’t buy cheap Chinese flea market shit that won’t close after you hit anything with it.

No, it's illegal to possess at all - there is no qualification on possession in the code.

No again. The reference to spring-loaded in the description refers to the flex of the baton when used to strike - that is the spring action referred to not the means of extending the baton - if the baton when completely extended is rigid, i.e. does not flex, then it is not prohibited, if it flexes then it is prohibited.

There is no right to defense of property in Canada. In the US constitution there is, and that's why they can shoot people when they trespass. Our constitution contains no similar provision.

They are available in malls such as market mall. Go to any knife store such as cutting edge and they usually have a nice selection of them. For a good one that wont bend and not go back into the handle after use is usually around $120. They are very helpful in dire situations, which is why i keep one in my car.

If these batons are illegal, why do they sell them in malls in Calgary? The Law - 1 You - 0
