Because the offence of 'Refusal to Provide a Sample' is deemed by the courts to stand alone from the Impaired Driving itself (ie. the offence completely begins and ends by definition after the driving), it cannot be tied directly to the driving by way of punishment. This is how the law used to be. But the loophole is now closed. As of July of 2008 there is now Sections 255 (2.2) and 255 (3.3) which provide that where a person refuses to provide samples and there is injury (2.2) or death (3.3), that they are liable to the same punishments as if they blew over and did the same. But only if at the time of the refusal they knew, or ought to have known, that they caused an accident which resulted in injury or death.

So this guy will not get the benefit of any loophole.

Clearly it was the fault of the van making the left turn. They should have anticipated the fast BMW.

Someone should really video tape cars going through that intersection and prove that going 200 km/h is safe.

I always hope drunk idiot drivers like these wrap their vehicles around a pole or get wedged under a large cement truck, but they always tend to take innocent lives instead. Killing or nearly killing these idiots is the only way justice can be served. In this case, he should have been the one with a tarp covered over him. RIP.
