Default What do you do when an employer won't give you your last paycheck?

My girlfriend was working as a tutor as a part time job for 2 months before she gave her 2 weeks notice. Now they've been giving her the run around about her final paycheck for the last 3 weeks. She called Alberta Employment, and they said that she should have received her paycheck within 10 days of her last day of work. After that, she's eligible to file a complaint and they will investigate, but they wouldn't say what the investigation will do for her.

Does anyone know what the complaint will result in? Will they get her check for her?

the complaint is a formal request for your pay (technically a threat to sue if the don't pay), if they don't pay Alberta Employment will investigate and help you with lawsuit stuff.

Best way to get the money is to disrupt business. Just show up there, make the situation uncomfortable, make them loose a customer or two! They will pay you quickly

Investigation will definitely speed up the process. Unless the company is useless. "Higher ups" will take this seriously, or they should.

Just tell them you are going to file a complaint if the paycheque is not paid **IN FULL** in 24 hours. Go in and speak to the highest up you can. They will pay you...happened to me before and I filed a complaint anyways cause the guy was such a prick. I got "laid off" but yet he hired someone 5 days later...after the complaint he ended up selling the business hopefully he got charged or something was never told what happened nor bothered to ask.

    Not so much.

Depending on the situation the individual you confront might have absolutely nothing to do with the fact you have not been paid.

Call the Head Office and instruct them you have contacted AE and filed a complaint. Tell them you will withdraw the complaint if the pay is forwarded within 2 business days.

That is how grown ups do things.

Seriously though, what kind of business does this to people, especially this close to Christmas.

OP, what's the name of the company?

Don't wait. Just file the complaint. They can order the business to pay and they can make their lives miserable if they don't. The best part is that it's cheaper and faster than getting the same results through court.

The complaint will do more than you think.

I had to talk to the labour board about a company stopping my last paycheque. In the end, I ended up getting more than the cheque itself, as they were not paying me vacation pay.

The company is Access Tutoring . It sounds like it's a sole proprietorship run by a Susan Thompson, so there are no higher ups and no location other than her house to go make a scene at hahaha

My girlfriend has been making demands for the check multiple times every week through email and phone calls, so Susan has until today to have the check in her mailbox before she files the complaint. She also contacted all of the families she tutored for and they have given her email confirmation of the hours she worked, which is what AE suggested as evidence for a complaint.

All the families are pretty unimpressed with Access Tutoring now, which is a bonus. So, might as well warn others, Access Tutoring sucks balls, and Susan Thompson is a grinch trying to steal Xmas, stay away! IMO of course

File the claim, write a letter to Revenue Canada reporting the possibility the owner of Access is not fully documenting business income and leave it at that.

Revenue Canada must investigate all letters of concern, my uncle works in the investigative office. I did this to an employer who thought it wise to hold back a paycheque from me once the university summer job was completed. He had so many income streams, Revenue Canada were like ants all up in his business for a year. Revenge served, life goes on.
