    Default Anyone a tax accountant/lawyer?

    Just need a simple-ish question answered. Will pay if it’s more complex but suspect someone can answer it in 12 seconds if they understand the ‘moving expenses’ part of CRA

    Kind of an odd one.

    - We lived about 100 km away from my wifes work. She was going to the office 2-3 days a week following Covid.

    - We were able to get her moved to office in another town, that is preferable for us, so her commute is now 2 km away (and meets the 40 km minimum requirement for moving expenses).

    - she is still technically reporting to the original office people, and occasionally has to drive all the way there. Very occasionally (has gone once since we moved in September).

    - I think the key concern to me, is that we did do the move in September, but are still waiting for a desk for her in the new office. She has worked remotely almost entirely since moving. Likely getting a seat in the next month or two.


    Do we qualify for the move expenses?

    So, you didn't move your home, but your wifes job moved? I don't believe that qualifies.

    Did you incur legitimate expenses to move her office? Like did you hire a moving company?

    The move wasn't required for the job as the job move came after. I don't think that would qualify.

    If you want to be truthful per the CRA I don't think you can because she still reports to the old office though once she gets a desk at the new place then maybe you can. However then your house move and her work move are in separate tax years.

    This came up where a couple moved closer but didn't have a new work location in the same tax year and the CRA rejected things. But they were also idiot lawyers and claimed 55k in deductions probably thinking they could outsmart the system.

    It’s significantly different? Red deer to Cochrane, we’re just waiting for a desk to open in new location as they’re cramped for space


    Do you submit it and then just tuck away any tax return and wait to see if they say yay or nay? Bad idea?

    If I was in your shoes I probably would claim it and submit it. Presumably won't claim 50k+ in expenses and raise some flags to start with. Just make sure there's some kind of paper trail saying she's transferring to the new office, and she'll have a desk soon. So long as there's a paper trail and not just verbal I'd roll the dice and you'd likely be fine.

    Just claim it.

    My FIL claimed all sorts of things. Never once was he questioned about it.

    Original question was worded weird. If you moved your home, and your wife has a new workplace on paper, claim for sure, zero question.
