Canadian BitTorrent User Fined $60,000 By U.S. Court

A new dimension was just added to the ongoing stream of BitTorrent lawsuits in the U.S. A Canadian BitTorrent user has been ordered to pay $60,000 by a U.S. District Court judge. The Calgary resident, who did not defend himself, was ordered to pay the damages for sharing two films on an adult-oriented BitTorrent tracker.

I'm pretty sure this isn't enforceable?

The adult entertainment studio Corbin Fisher filed suit against Phillips, who they claim had illicitly shared two of their movies (“Turner F***s Austin” and “Keagan” ) on the BitTorrent tracker Gaytorrents.ru.

Turner fucks Austin and Keagan.... hope it was worth 60k

But I can see the US doing this more often. Make some basement $5,000 budget amateur porn. Upload it to a torrent and wait for someone to copy it - then sue for (I think $250,000 US is the maximum)

Its sort of like a honey trap insurance scam. The US excels at it nowadays. Its sort of like sueing Khadafi for cutting internet access (because you can't sue him $$$ for murder)

But its not like $60,000 US is actually worth anything nowadays.

There was an article earlier this year about how some companies were doing something similar - they made budget titles with very explicit names, and then demanded settlements before filing a suit revealing their name as having downloaded a very lude titled porn.

That happened with a movie called nude nuns with big guns. They made it, and its supposed to be horrible, it got on torrents and now the studio is trying to sue a bunch of people. First they send a threatening letter demanding 2 grand, then another demanding 5 grand then they try to sue. If everyone paid the first demand for 2 grand it would gross more than avatar. Funny thing is...you can't buy the movie anywhere.
Step 1: make a crappy movie on a small budget
Step 2: give it a lurid name
Step 3: put it on torrents
Step 4: Sue and get rich

I do like the Harper copy write legislation that’s on the table. Will make it easier to sue downloaders BUT it recognizes a difference in person use infringement vs commercial infringement. Personal use infringement will be limited, by law, to 5 grand for ALL acts of piracy. Thus, it won't make financial sense to sue anyone so no one will get sued.

Not really, thats the idea behind the initial "give us money" letters. People simply pay. No court. Works well with porn as a court hearing would result in their names being published, even if the sender of the extortion letter has no intent to actually sue anyone. Think about it…you threaten to sue 5865 people and send them a nasty letter asking for 5 grand to settle, as in the case of nude nuns with big guns, and only 5% freak out and pay the 5 grand you ask for to settle…..that’s more than a million bucks. Not bad profit being that Nude nuns only cost $85000 to make. Especially true with porn…people, even if innocent, will pay up as they don't want their names publicly associated with "Teen anal sluts 7". Not surprised the lawsuit in this thread was filed for a gay porn flick. Bet they figured he would simply settle right away rather than risk being outted.

I watched that movie, or rather, I tried to watch that movie. Fuck it was horrible, if the boobs would have been half decent I could have made it all the way through, sadly, they weren't.
