Problem with Roofer - need advice

2 weeks ago my neighbour was having his roof done and one of the guys on the crew was pretty green and put a roll of roofing paper on the roof. The roll slid off right away and smashed into the side of my house. it broke a few pieces of siding and a corner cap, and scuffed the siding from the ground to almost the second floor.

At first the owner (of the roofing company) said he'd take care of it.

as you can imagine, promise after promise came and went and nothing has been done.

I've already opened a claim with my insurer, but haven't activated it yet. I'd prefer to not go thru insurance and I don't want to get my rate dicked with.

Today I tried calling twice to get some info from him, but he's not answering or returning my calls.

What course of action to I have here? Can I file a police report for property damage? Small claims court?

I'd start by posting thier information all over the internet. phone them from a different phone number, tape calls

Roofing company's fault. Go after them, not the home owner.

I'm going thru the same problem with Merit Roofing. The morons they have working for them were chucking my neighbors shingles against my house and scratched the crap outta my siding and windows.

We've called repeatedly and just get the run around. Avoid Merit roofing at all costs.

Couldn't you let your insurance deal with your neighbour's insurance?

He should have insurance. I stress the word SHOULD. As a owner of a roofing/siding company sometimes these things are unavoidable. But his insurance should cover it, granted he would even put in a claim. I would take immediate pictures of your home and if they are still working on the roof pictures of them.
