    Default Pedestrian

    My son is about to be given a ticket, the cop said that a lady had to get out of his way at a crosswalk. My son said he never seen no such thing happen(who knows for sure) The cop said that she has to give him some kind of ticket and not sure yet, but possibly a "failing to yield for pedsestrian", now if it wasn't me paying the insurance I would not possibly fight this, all the pedestrian has is a description of the car, no plate. So my question is how much for demerits,fine and insurance increase? Should I get "points" or somebody like that fight that for me?

    Is it a super rare car or something, can't see it holding up as with no plate and with the average person not being able to distinguish between any cars there is no proof?

    If he's never seen no such thing happen, that means at some point he's seen such a thing happen. Why don't you ask him when he's seen such thing so you know when he almost mowed down a pedestrian?

    There was no cop there. It would be a registered owner ticket. Fine only, no demerits, no insurance hit.

    2. Pedestrian calls police with vehicle description
    3. Police officer somehow tracks down vehicle with only a description to go on
    4. Son getting ticket
    5. Dad fighting it for him?

    No plate, non-Police eye witness. If you get a ticket, fight it in court. Sounds like they have no evidence.

    Having said that, how did you wind up with the ticket? How did the cops know it was your son's (or your) car? There is more to this story I feel...

    If this is the case, im calling in shit like this with vague descriptions on peoples cars that i don't like!

    Sherwood Park is small... maybe Junior is well know or his car is...

    I'd make Junior pay for his own insurance if he's going to drive like an asshat!

    Much, much more to this.

    I'd bet anything that kid and/or the car is known to police already. No other way they could track him down by a description alone.

    It will be a RO ticket that is very easy to fight.

    Simply get a bunch of pictures of cars that look like his, same color/model/make etc.., put a picture of his in the batch and have her pick it out. I'd find out exactly where it supposedly happened and if traffic goes N/S, ask her if he was traveling eastbound or westbound. Either of these should create more than enough reasonable doubt.

    Got to be more to the story. Cops around these parts (everywhere) are lazy, and can't be bothered to do basic police work for violent crime investigation, let alone the word of some guy with no evidence about a moving violation.

    im going to assume they recognized the driver himself, it sounds pretty suspicious that they tracked down the car based only on a description

    I'm pretty sure that there's more to the story. No police officer would even bother pursuing a moving violation like this unless he or she had some evidence, and a real lead on finding out who the driver was. A simple vehicle description will not cut it. I've seen cops do nothing in more serious cases where more evidence was involved.

    CPS had to have had the plates or somehow gotten the RO's name.

    Even with a plate this is the easiest ticket to fight.

    Just say NOTHING to the cop if she issues one and get it tossed by the early appearance crown.

    Wow hateful people here and yes more to the story. Kid took friends to another school where there was a confrontation, half of kids new what was going on to begin with few found out on the way. Kids left when teachers approached, spead out of PARKING lot not street with cross walk. Cop pressure kids into saying what they wanted to here, and all of a sudden a week later this so called witness came up saying there was an indence, (like a week after my kid already talked to cops. Sounds fishy and yes I am fighting for the kid because it comes out of my pocket, not rich and trying to get best deal, for idiot who thinks hes got a better way let me here it, thanks for the rest for your response.
