    This guy is not driving your Mom's C230 - it is a top of the line - tuned from the factory AMG Black Series. The fact that is is trying to pass it off as merely a stock car is quite amusing. By the way, people are still wrapping their cars with matte wrap? LOL

    Aren't those contradicting sentences? He states that it's "tuned from the factory AMG Black Series", yet it's not stock?

    I'm no lawyer, but now giving serious thought to going to law school lol.

    Anyone talked to a lawyer? We could collectively challenge the Bylaw. I would be in for a donation.

    If we need this Bylaw, it needs CLEAR and defined measurement technique AND distance.

    Based on this:

    A Bylaw can be quashed in court, based on;
    Uncertainty – Grounds on which a bylaw could be struck down because of uncertainty are:
    vagueness;
    lack of substance or form in the bylaw;
    lack of substance or form in the proceedings prior to its adoption or in the timing or manner of its adoption;
    or because it was procured through a violation of The Controverted Municipal Elections Act (e.g. bribery and threats).

    And

    8. Infringement – Bylaws may be found inoperative because it:
    appears to supplant or duplicate federal or provincial legislation;
    may create a situation in which compliance with its terms constitutes a breach of federal or provincial legislation; or
    may undermine rights provided by The Canadian Charter of Rights and Freedoms.

    Hahaha we have to turn off my buddies truck everytime we go through the drive through because of his diesel.

    My question is wouldn't literally every semi-truck fail?

    I find that diesels are especially noisy at the front of the vehicle, whereas the exhausts most of us have carry most of the sound to the rear of the vehicle (save for open downpipe exhausts) . Even still, I've never had trouble at the drive thru window with a diesel truck behind me, they usually have to shut it off when they get to the drive thru microphone because engine bay noise, but never affects me.

    This by-law is an unreasonable unfair exchange of peoples rights and freedoms. I almost want to get tickets intentionally in my "FIT" so that I can go to court and fight them.

    I think we should sue the guys that made this silly by-law.

    As I have mentioned before, having the bylaw struck down would be very difficult. It doesn't offend any of those principles you mentioned, so it's not that easy.

    I'm not saying it's impossible to get it struck down, but why go through all of that trouble when there is a quicker, easier possibility?

    It's much easier (but still not easy) to get City Council to change the bylaw than to have it struck down. The hard part is getting the aldermen to understand what the problem is with the bylaw so that they see the need to fix it.

    Getting this on the news is a huge step in the right direction - if the CBC bothers to put why we say the bylaw is arbitrary into their piece.

    I quite like yycyyc's comment:
    I have read some of Shelton's research into this matter and find it silly that stock cars would fail. I would rage too if I was him and was getting tickets for having an unmodified vehicle that exceeded the supposed city councils 96db level.

    I hope the city has hired additional call centre staff as the amount of complaints are going to be staggering to this law. I believe in tickets if you break the law. Get a ticket speeding? Its most likely deserved but i consider myself a relatively law abiding citizen and to be penalized for essentially nothing is really pointless. A total cash grab. I rarely bitch about laws but the level that the sound is set at is really low imo. My bike will be illegal 100%, ill have to accept it and fall in line with the other 50 city oriented cash grabs. They can feel free to install noise meters in restaurants and write tickets to obnoxious people with laughs and cackles so loud it disturbs every person in the restaurant....

    I might actually get one with my Tiny Fiat 500. Straight pipe with a tip.

    But always respect neighborhoods, low rev and coasting. Only time I would press the pedal is when I'm out of the neighborhood.
