He handed over $80k without a contract signed by both parties?
I'd imagine he has a case, but it's probably going to be a real pain in the ass to successfully sue without some sort of agreement with promise of delivery dates and what happens on a miss of delivery dates, etc. Not to mention these guys sound like they probably don't have a lot of cash on hand.

He signed the geoduck company's contract and faxed it back but the contract my brother sent to him wasn't signed and faxed back.
When you said seafood and China, I couldn't think of a better investment than geoduck, which has a very high market price.

There was a contract signed that the seafood company sent to my brother with both their signatures on, and they both have a copy each of that one, but the contract that my brother sent him from his company to get signed was never signed or faxed back.Originally posted by FraserB

My brother got a hold of his broker in the States and he said that he can return $20,000 to him but the rest will have to wait till they can get more investors to invest into them and they can pay him back then?

They've obviously spent 75% of the deposit, and still don't have everything together to deliver.
Yes, your brother can probably sue for breach of contract, but if there is no money or assets that can be readily turned into cash, what is that going to accomplish?
He should think about taking the $20k they have now and and then deciding whether or not to sue for the rest. The other side to that is if there's a reasonable chance that they will get the business operating, taking the $20k may completely sewer the business and make it extremely unlikely that he will get the other $60k back.
Bottom line is it's all a gamble - maybe he could try and look at this company's books and plans and assess the likelihood of them being in a position to pay them back later?
Yikes thats pretty insane. Time to get a lawyer who specializes in that type of deal.. Hell if your brother wants to invest in things so blindly , he can invest in my companies

Sounds like it's time to govern yourself accordingly, so this company is legit in Vancouver? Any asset that you know of? Better get in line if the ship is going down. Regardless of why the products cannot be delivered, it doesn't sound like they will be here anytime soon. Unless you know that company is going to put their shit together and wait, you'd better act now.
