    He handed over $80k without a contract signed by both parties?

    I'd imagine he has a case, but it's probably going to be a real pain in the ass to successfully sue without some sort of agreement with promise of delivery dates and what happens on a miss of delivery dates, etc. Not to mention these guys sound like they probably don't have a lot of cash on hand.

    Out of curiosity is the seafood product geoduck clams?

    Lol sorry guys I will edit it in paragraphs later was writing this at 3 in the morning. But it is the geoduck product, how did you guys guess?

    He signed the geoduck company's contract and faxed it back but the contract my brother sent to him wasn't signed and faxed back.

    When you said seafood and China, I couldn't think of a better investment than geoduck, which has a very high market price.

    Oh, yeah that's why my brother got investors to invest into that product because the market is high enough for him to get 3 times his return is what he told me.

    But as for a lawsuit would you think it is possible? and for how much my brother was thinking he might be able to sue for?

    How is going to sue them? He has no signed contract, the judge is going to toss the case, maybe make him pay the respondant's court costs and give him a lecture on why you don't give people $80,000 with no contract.

    There was a contract signed that the seafood company sent to my brother with both their signatures on, and they both have a copy each of that one, but the contract that my brother sent him from his company to get signed was never signed or faxed back.

    Also I dunno if personal emails from the seafood company would help?

    Not to mention international law/jurisdictional issues.

    High-risk investments have their place - Provided they are identified and accounted for as such.

    As far as I know, emails are considered admissible.

    Would people think that this business be a Ponzi Scheme in a way?

    My brother got a hold of his broker in the States and he said that he can return $20,000 to him but the rest will have to wait till they can get more investors to invest into them and they can pay him back then?

    It doesn't sound like a Ponzi scheme. It sounds like the company promised to deliver before they had all their geoducks in a row to do that, hoping to get other financing together to make everything go in time to deliver.

    They've obviously spent 75% of the deposit, and still don't have everything together to deliver.

    Yes, your brother can probably sue for breach of contract, but if there is no money or assets that can be readily turned into cash, what is that going to accomplish?

    He should think about taking the $20k they have now and and then deciding whether or not to sue for the rest. The other side to that is if there's a reasonable chance that they will get the business operating, taking the $20k may completely sewer the business and make it extremely unlikely that he will get the other $60k back.

    Bottom line is it's all a gamble - maybe he could try and look at this company's books and plans and assess the likelihood of them being in a position to pay them back later?

    Yikes thats pretty insane. Time to get a lawyer who specializes in that type of deal.. Hell if your brother wants to invest in things so blindly , he can invest in my companies

    They may not look like much but they sure are tasty. Cut the trunk into thin slices, dip a piece into boiling soup of for 10-15secs, ready to eat. Use the body to make soup, yum.

    Sounds like it's time to govern yourself accordingly, so this company is legit in Vancouver? Any asset that you know of? Better get in line if the ship is going down. Regardless of why the products cannot be delivered, it doesn't sound like they will be here anytime soon. Unless you know that company is going to put their shit together and wait, you'd better act now.
