    I have a question regarding photo privacy/copyright laws posted on social networking sites and newspaper...

    I recently posted a photo of myself on my Instagram account. A company later took that photo and posted it on their Instagram, FB, and Twitter accounts as I was wearing one of their products. I later find out that a division of Sun Media printed my photo in a local newspaper as part of one of their articles... Question is: Do I deserve any type of compensation or royalties for my photo being printed in the media without permission?

    Yes, you deserve at least 20 grand for your efforts.

    It depends... did this photo get used after January 19, 2013? There are now new agreements in place:

    You gave permission, did you read the small print when you signed up? I bet you just clicked APPROVE or OK like the rest of us.....

    The social site is free, they get revenue from advertising, selling your user information, selling your photos, selling all they can from the data and content you provided for free. Much like beyond.ca, they can do as they please under the agreement, they are free to change the agreement as well at any time. Normal business these days, 1984 passed some years ago.

    Ask Rage how the business is going, he could provide a better overall view should he desire. A business like any other, watch what you agree to.

    Read over Instagram's privacy policy.

    They owe you nothing.

    If you don't like it, don't use their service.

    Seems like you gave them permission when you agreed to the Terms of Service.

    Those new terms are the reason I deleted my Instragram account.

    ..are you a professional photographer? I would guess no, how do these new terms impact your life whatsoever?

    I love how one-sided this instagram agreement is. The limitation of liability and indemnity alone make me cringe. At work, I spend a disproportionate amount of time explaining software agreements like this. It's generally shocking to people when they find out what they are actually agreeing to when they click "I accept".

    So for instagram, yeah... they don't owe you any money. While you may own the content, you've already agreed to let them use it for free.
