    Default Discrated Driving ticket.

    Okay so i have an issue that happened to me yesterday on the way home from work.

    Was waiting at a red light and a police officer was coming in the opposite direction
    As he passed me we both looked at each other and i watched as he turned around. At this time i knew i was going to get pulled over but had no idea why.
    So the light goes green and sure enough i get pulled over shortly after. He comes up to my window and asked if i knew why i was getting pulled over and i said no, And he replied that i was talking on my cell phone. (which i honestly wasnt, my phone was in my pocket.) I tried to tell him that i was not on my phone and that he could even g through my phone if he wanted.
    This is when he started to get aggressive, Calling me a little prick and to stop running my mouth to a police officer. (I wasnt even being rude, i was being polite)
    So he comes back after taking over 30 minutes to write a single ticket, and proceeds to tell me that he saw me CLEAR AS DAY on a black and silver phone. I then took my white phone out and showed him that it sure enough was not black and silver and he just told me to stop lieng though my teeth to him.

    I walked away with a distracted driving ticket for 172.00 for not doing anything. I was wondering if this would be worth it to take to court or would it be pointless because it is his word against my word.??

    I plan on filing a complaint against the police officer but i was wodering if anyone could shed any insight on my situation here.

    only advice i can offer is your phone has a voice recorder turn it on next time that sucks big time good luck

    lol... quit talking on you phone...

    Fight it if you are innocent for sure. You can also get the officers notes if i'm not mistaken to see what is in there.

    I know one of these days I'm going to get pulled over for leaning my head on my hand

    You're basically S.O.L.

    His word against yours, you have absolutely no way of proving yourself innocent or that you were mistreated. He might have made notes that it was a silver and black phone, or you might be able to pull your phone talk/text/data usage, and prove there was no activity at that exact moment, but probably not.

    Tough break, did you get his badge # at least?

    take it to court, i got out of a six point careless driving ticket, cuz the officer didnt have enough evidence, all i did was change lane without a signal. and it was my word against his.

    That is what I was thinking, although I will still probably bring it to court and see if it will get reduced at least. I have his badge number and his name.

    Yeah next time I am going to use my voice recorder just in case things like this happen again.

    All you have to do is provide reasonable doubt about the accusation. The fact that the color he stated is wrong, and there will be no activity on your cell phone, pretty much provides reasonable doubt.

    Fight it. Make sure you get his notes first to find holes in his BS story.

    It's pieces of shit like him that give the CPS a bad name. If this goes to court, please let me know, I would love to watch it.

    The hell man? Seems people in general are going full retard more recently. Hopefully you get the ticket kicked, sucks you had to go through all that tho.

    I very much doubt the officer would even show up to court in this situation where the ticket is a complete farce. Sounds like someone's quota was just low, or they didn't like you for whatever reason.

    It doesn't matter if you're completely guilty or not. ALWAYS fight your tickets.

    The reason these cops hand out so many bogus tickets is because most people don't bother to fight them, so they fill their quota easily.

    If anything, I would argue that the cop was distracted lol. He's supposed to keep his eyes ahead on the road, a small child can jump out from the sidewalk while he's admiring your black and silver phone. A side by side stare down? WTF officer, eyes up and ahead.

    It's totally normal for a cop to pull you over, accuse you of talking on the cellphone, call you a liar and a little prick. There's no doubt that's exactly what they were taught and trained to do, yup.

    Get your phone records and take them to court with you, if they don't show you on the phone at the time of the ticket then its no longer his word against yours.

    I fought mine and yeah it was a pain in the ass but at least I got the demerits eliminated..worth the price of admission
