    When people do shit like this they generally pull the e-brake so you don't

    GF is lucky she did not get charged for following to close and distracted driving.Have her brakes checked and eye test as well.

    If i was the adjuster for the BMW I would not accept the liability on this one at all. His braking was clearly negligent and the cause of the accident.

    Will her insurance company even assign an adjuster to look at her car as she only had PLPD coverage? If she'd have had collision coverage, she'd have access to an adjuster from her insurance company with no issues - maybe a Beyond insurance guru could comment on this.

    I am an beyond insurance guru . Just been dormant for quite some time.

    Even though she doesn't carry physical damage coverage for her own vehicle an adjuster (probably 2) still gets assigned. An automobile physical damage adjuster will be assigned as even though she can't claim on her policy for damages you can be rest assured the other guy is going to try to recover his damages and her Section A Liability coverage applies. It is that adjusters job to handle the demand from the other driver or their insurer and determine if they will cover it or not. The other adjuster could be a bodily injury adjuster as the BMW girl may or may not have injuries for which there is coverage under Section B Medical Benefits.

    So she does have access to an adjuster who I would hope would deny the claim from the third party given the circumstances.

    As far as the damage to her own vehicle she will have to deal with the other guy or his insurance company directly to recover for her damages and unfortunately I expect that the other company will not accept any liability unless BMW girl sues the individual and likely takes it to court.

    Its a shitty situation all around.

    The more I think about this the more I'm convinced it was intentional and a scam.

    In addition to the things everyone else has mentioned, look at the way he veers off to the right of the lane just before braking, and look at how the vehicle is orientated once stopped. If he had been in the centre of the lane there probably would've been room on the right side for the BMW.

    Guaranteed scam. Who the fuck brakes on a overpass like that, nobody will EVER expect somebody to come to a complete stop on that road. Almost no reasons that I can think of for somebody to stop in conditions like that. There's next to no possibility that there would be a pedestrian there crossing a road or a kid chasing after a soccer ball or an animal running across. All the cars in front of him pass over the same sections about a second or 2 in front of him so we know there's no road debris. Furthermore, if he actually wasn't paying attention and saw the car in front of him brake (which didn't, no brake lights in video), who would come to a complete stop when they realize the car in front isn't slowing down.

    The spot on the bridge connector is good too, that definitely was an advantage for him, by the time she started braking, she would have gone over the connector, guaranteeing that she would have a longer braking distance then the Honda, especially if you factor in reaction time.

    any updates on this?

    I once had a Advance Cab drive straight into me on the intersection when I was making a left turn - he came out of no where - police didnt even give me a ticket - but 6 years after it my insurance company calls me up and says he has been doing claims in excess of 100,000 and it seems like he is scamming the system

    his insurance did pay to replace vehicle.

    even if he was texting, its her fault i could think of 3 ways to avoid this accident. he can say i braked because i saw smoke coming out of the car, her fault is she had all the time in the world to slow down or to avoid him, but she didnt, she said OH MY GAWD like 10 times instead.

    insurance scam on a freakin 2000$ car, like honestly and neck scam, kid was jumping out of the car, if he wanted to do the neck scam he would have requested ambulance.

    give him 500$ and u will never hear from him again, however i would estimate the damage to be between 1400 - 2000 $

    not to mention he slammed on the brakes like a douche @ 0:28 she was going 72 km/hr, she hit him at 0:32 she was going 69 km/hr

    she didnt even touch her brakes, she was texting !!
