This is the type of thing that only re-invigorates it though. I understand their copyrights on the Mario characters etc., but so long as the game wasn't altered (ie you aren't suddenly going to be playing on a level shaped like a penis), there's no reason to try and shut it down.Originally posted by A790

1) Nobody is paying to play the game. Mario can be bought on the Wii store and through various other outlets. So, in effect, this is basically an online ROM of the game.
2) Nintendo does not have the ability to control how the content is presented.
3) The game WAS altered by adding a level creator, so your penis scenario can actually happen (and probably has already, this IS the internet).
I'm not saying that the site is evil/bad/etc. I really enjoy it actually. However, I don't see the sense in lashing out at Nintendo for doing what every other IP copyright holder in the world would do.
