If you rear ended a 3rd party - 99.9% of the chance you are at fault.
I would give the 0.01% only if you have a dash cam to prove that you are not at fault.

I was in an accident about 2 years ago, and was the very rear car in a 5 car pileup. The guy that caused the accident was given a few tickets for causing the accident. My insurance immediately said I was at fault, but luckily his insurance company came back after seeing the police reports and took accountability and paid for everyone's damage.

Since they took accountability, my insurance changed their minds and found me not at fault. This probably wasn't helpful in this case, but I wish you luck!

I had a similar situation happen to me a few years ago going from Barlow onto 17th/blackfoot west.

I was accelerating to match speed and move over. Guy in front of me stopped when I shoulder checked. I was right mad because it wasn't even a merge, but a continued lane.

The guy I hit was quite nice though. His car had a paint scratch, my nose went under him and ruined the hood, rad, fenders, etc. Accident report was filed, but nothing went through insurance. I was lucky that way, but I ended up scrapping the car.

Despite my good/bad luck, I knew that I was at fault. It was just horrible timing and putting trust in the person in front of you. If the scenario was different and he had to stop for a reason, I wouldn't have been so angry with him, but the outcome would have been the same. Now when I come around that corner, i speed match AFTER I complete the turn. lol

I've done this twice. After the second time I've never EVER again checked to see if I am clear until the person in front of me is well gone. I am sure I upset the people behind me and am waiting for the day I get hit, but I just dont care.

I do exactly the same thing.

I've also set the mirrors on the truck so that there is zero blind spot along the sides.

More people need to learn this - my kids taught this old guy how to do this and now I find unnatural to have my side mirrors adjusted any other way.
