    Agreed that is is absolutely not justifiable homicide, but I think his point is that it is likely to be an isolated event because the person would be reacting to a very specific highly emotional/stressful event. Unless he repeatedly re-married cheaters, repeatedly caught them in the act, and did not learn his lesson after the first stint in jail, he is unlikely to re-offend if those were the circumstances leading to the homicide. In the case of the mentally ill, if they are killing for no reason, it's arguably more likely that they will do it again because the 'triggers' aren't necessarily something rational or predictable.

    I just hope that if he reoffends we can lock up his shrink for signing off.

    Honestly, what shrink in their right mind would ever put their reputation on the line to confirm it’s safe for him to be out in public.

    Yea I dont get the NCR ideology for a second. Bleeding hearts.

    These people need to repay their debt to society with forced labour of some kind, instead of sitting around. I could see this person for eg. made to work in a palliative care unit (cleaning floors, make beds, etc.) the rest of their life.

    Thats not hes was saying. He was saying that, in the mind of the killer that murder (rage, hate,etc.) was self-justified.

    Same as being temporarily insane - so why weren't they NCR for the moment they committed the murder?

    There are two aspects to any crime, within our legal system, the actus reus (the physical act) and the mens rea (guilty mind). You basically need to have both to be criminally responsible for anything. So in this case, the defendant claimed he did not have a guilty mind by way of insanity, they then had to prove that he was not aware of his crimes and did not have mens rea. It gets a little muddled with things like manslaughter by negligence, either in a car accident or otherwise.

    In this case, it was proven that the defendant is a schizophrenic and thought that these people were demons or something, I cannot recall the exact case. There are lots of people that try this defense even though they know it wasn't really the case, but you hope that our legal system, along with psychiatric experts can recognize this to be untrue.

    In this case the family of the victims is trying to have the Criminal Code changed so that people that were found not criminally responsible are never given a full release. This young man is interesting in that while in the psychiatric institution he stopped taking his medication and they did not notice he was moving down the same path as he was previously until it became severe. Which makes it a scary situation if he is out in the public and just chooses to stop taking his medication.

    We used to put these people in insane asylums (which was dumb as there often was a cure). Now its back on the streets (which is equally as dumb).
