It's not Mar's problem if he didn't understand - he was very clear, $40 per hour.Originally posted by GTS4tw
I dunno Mar, that's some pretty loose wording. He seemed to only agree to $40 and there is some language barrier, you are still in the right, i can just see how he may have been confused.
The other guy responded "40$? ok...."
Then Mar outlined later, 3 hours, $40 per hour = $120 and the guy didn't say anything after that about there being an issue. Seems very clear he understood, despite the language barrier.

There was clearly miscommunication in the e-mail.. As A790 had mentioned, Mar should have accepted payment first or at least clarified the total amount before he did any work. Brought this on himself, as usual.
Can you imagine every time on American Restoration if Rick Dale said he'll do a job, just said he charges $80 an hour, and then when he finished the work, he's like to the customer.. "Yeah it'll be $12,000 please. $80 x 150 = $12,000."
Just bad business practice man.

Seems pretty cut and dry to me, I don't think Mar is in the wrong here. Mar clearly said "$40 per hour" and further said "3 X $40 = $120" which would break through almost all language barriers, and the following email from the the Shooter did not have any objections in it about the price which was just clearly outlined for him with numbers, not words.
IMO this is not at all Mar's issue, I would have done the same. I don't think it gets more simple than clearly writing out the price, including in equation form What more can you even do?
What I'm saying is Mar should have used his head and caught that it didn't seem very clear and probably did a proper quote before actually doing the work. He only said it was $120 after the work was done. That Shooter guy was stupid for agreeing to it, but I would say Mar put himself in this mess himself. Should have caught it earlier.
It's not Mar's fault, but he could have prevented this pretty easy.

Of course he didn't say it was $120 after the work was done. That kind of situation is nearly impossible to quote, so he quoted his hourly ($40, which is $25/hr cheaper than I charge btw) and then completed the work in 3 hours.Originally posted by Disoblige

I feel like we're grasping at straws to justify the customers non-payment, but after those e-mails I don't see how such justification could exist.
This cannot possibly surprise you!Originally posted by Mar
This certainly derailed.

I say stupid shit all the time.
The contract isn't the point. Not sure what the point is really, except maybe that death threats over a $60 disagreement are hilarious?
This video is sort of relevant... Long but a good watch, I think:
Link to skip the long intro.
An uppercut would have solved it better.

Thanks for the 14 years of LOLs. Govern yourselves accordingly and avoid uppercut reactions!
