    Effective July 1 2014

    Canada’s Anti-Spam Legislation

    This is the first I'm hearing about this.

    Violations

    20. (1) Every person who contravenes any of sections 6 to 9 commits a violation for which they are liable to an administrative monetary penalty.
    Marginal note:Purpose of penalty

    (2) The purpose of a penalty is to promote compliance with this Act and not to punish.

    Maximum penalties

    (4) The maximum penalty for a violation is $1,000,000 in the case of an individual, and $10,000,000 in the case of any other person.



    Now Canada is attempting to police the internet, they can't even police their own streets.

    Fuck them for trying to help control spam, which takes ten's of billions of dollars from the economy every year.

    Fuck them but placing laws that enable them to enforce it, should they choose to.

    Fuck them for not having all non-digital crime eradicated before they decided to regulate spam.

    Good luck fining some email originating from nigeria.

    All this will do is increase the costs of doing business and waste the time of business owners having to worry about one more way they can go out of business.

    Cue the unintended consequences, as are expected with every government legislation, usually ends up punishing small business' while not solving any problems.

    Police the internet, LOL
    While you cannot even police the phone system or the streets or even the inside of your jails or the closed doors of your own parliament.

    It's like some guy that is claiming to be able to lift 10000lbs and the last time he tried to lift 30lbs he broke both arms.

    Yeah, if they're going to spend money on this, then they better start cashing in on some of the penalties. Wonder how well this is going to work out if you can't even find the dude sending out spam lol.

    It's great to see that you have little to no understanding of how the internet works, and why this legislation is an important first step in providing law enforcement teeth to deal with this crap and all the economic costs that go along with it.

    Sure! Once you complete this course. Then, go and write all the tests for at least your CCNP Security and CCNP SP. Once you're complete all that, then we can start on the law enforcement aspects.

    Yeah, I'll get right on that... I'm going to take those courses because a random dbag on the internet can't make an argument or clarify his point.

    Every time someone makes an empty claim that I'm not informed about a topic I'm going to enroll in formal education to learn every aspect about it.

    I made my point. You just didn't like it. Then you asked me to educate you, so I complied. To try and explain it to you now would be a waste of both my time and yours. I might as well try and explain it to my dog for the level of understanding you have. Not saying that you're a smart as my dog mind you... :P

    Seriously though. This legislation is a very important step. Not just for spam but for providing law enforcement teeth in a number of situations relating to online fraud.

    Will be interesting to see how effective this is. Looking at the government page about it you have to have three elements in order to send mass marketing emails. Implied consent, clearly ID yourself and have an unsubscribe option.

    Most of the spam I get would already meet that criteria. The tricky one is implied consent. If you sign up for a weekly mailer from a company the fine print will often say something along the lines of "by signing up you consent to getting offers from trusted partners" or something like that. That gives them permission to sell your email address to other companies. So even though you did not specifically ask for other companies to send you stuff there is a debatable "implied consent".

    The unsubscribe option works, after about a week of clicking it in the various offers you get it usually stops. For me anyways.

    As for this law being effective against a bot using gmail to spam people with Viagra ads...not sure. Its easy to find out where spam is coming from. Along with Bayesian spam filtering, blacklists of IP addresses are used on anti-spam services to block it. I'm not sure the government could enforce this against someone in china though.

    I suspect this bill is for a government dog whose personal email address is spam bombed for political reasons by someone posting it on Craigslist for free sex, or giving it to other solicitors to receive spam... these heavy fines and probably long jail sentences are so that the dog can efficiently carry out the Queens orders without stress from a outside entity.

    p.s. notice how a persons could be fined 10 times more then an individual... we as Canadian citizens are persons not individuals if you understand how the law works.
    Just like when a police officer asks if you have an ID on your persons.

    Okay I changed my mind, its probably to stop mass marketing... cant give any independent businesses leverage to cheat in advertising.

    So would political mass emails be spam?.. makes you think.
