I sold my car 27 long fucking months ago

This is really stupid and i don't know what to do.

On April 2013 i went to Red Deer to pick up my $5,000 deposit for my car. He said he couldn't make it to Calgary and it would be great if i would drive to Red Deer and pick up the $5,000 cash from him. I printed out that i picked up the deposit and how much was still remaining. The car is with me and he owes me $4,000 on it. He told me that he'll be in Calgary the following week to pick up the car.

It's been 15 months now and the car is still with me (on my driveway) and he's telling me to still hold on to it because he's in NWT for work. He also told me to sell it and give him his $5,000 deposit back. I told him that i don't have the deposit and spent it.

This is getting ridiculous now and i'm running out of patience.

15 months is a long time to hold a car, i would have told him to go fuffle up a gum tree after the second week. At this point, I would give him a week or 2 to come down with the $4000. Otherwise, sell the car to someone else and keep the deposit

Did you bug the shit out of him to give you the rest of the cash and take the car the week after you picked up the deposit?

A couple weeks to hold a car I could understand, but 15 months..

Sell it elsewhere, then keep the money, if he bitches excessively about, when he comes to pick up the car (which will never happen) perhaps hold onto the $1k, then give it back, but this is a complete load of BS, you could even claimed storage fees this whole time that would have eaten up that said $1k he paid on it.

I think he meant hold on to 1 out of the 5.....

Anyway, here is what I would do. Write to the buyer saying this has gotten ridiculous and you've held the car for him for way too long. Say that he has a month to come by and pick up the car after paying the remaining balance. If he doesn't make it in that time, tell him you will charge him storage fee of $250 per month or something along the lines. That will give him incentive to show up faster. Put a final deadline saying if he isn't there in 5-6 months, you will put the car back up for sale and he forfeits his deposit. Have it all in writing, so he can't say he didn't know what you intended to do.
